Concern for approval

Hey guys, I’m kind of  worry, I had a domestic violence charge back in 2014 and was arrested and out within the next day. My charge was domestic violence damage to property. My case later became expunged after I was released. When I submit my I-129F I also attached my disposition record stating the case is closed. Also the police records as well. Any idea if I will get rejected?  Sorry I forgot to include I am the petitioner.

As long as you provided the proper court documents, you should be fine. Your fiance/fiancee should be informed of the offense as the CO may or may not ask about it. A DV conviction against the petitioner does not prevent you from having the petition approved.

which is sad.

Not talking about OP as I don't know what happened, but people who were charged with DV and all kinds of abuse (if wasn't proven otherwise) shouldn't be let bringing overseas fiancees.

Proper court documents would be the case record and police records. Am I missing anything else? My fiancé already knows the whole situation.

That sounds right to me (although I admit the exact documents for criminal activity are not my fortè). Good luck!

Okay, that's one opinion and I respect that. I have to disagree, though...DV is such a broad category. What should matter is if the partner is now at a risk of danger or not....not a decision that could be decades old or non-abusive behavior that falls under DV. People tend to think of DV means physically assaulting a partner or family member, whereas it covers a lot of activities that do not involve anything so extreme. For example, intentionally breaking a girlfriend's phone can fall under domestic violence. Should that prevent you from being with your overseas love? That seems a bit extreme to me.

 

I do think there should be some more strict review of the petitioner's criminal history to ensure the safety of their partners (AWA crimes are the only ones that come to mind as being a petition killer here), but a blanket DV ban would cause undue burden and hardships on a lot of good people IMHO.
