AOS and Owning a firearm (merged)

Hi,

 

I live in texas and I am an F1 Student . I have a hunting license as well as a conceal handgun license. I bought a rifle gun to do some hunting. Will owning a gun affect me in getting a green card when me and my fiancée get married? Is there any questions on the forms asking about gun owner ship? Just want to make sure all will be good.Had anybody ever been in a similar situation ?

I don't believe there are any questions about owning a weapon or anything.. As long as you bought the weapon legally (all permits required and such) then shouldn't be any issue.

Crazy that your state allowed you being a NON RESIDENT.. Back when I got my CWP here in SC I HAD to send a copy front and back of my GC to show I was a resident and also proof I was a resident of the state!

 

Super cool that they allow you to get it.

Why would it affect you at all? You are someone that is here legally and thus able to carry/own a firearm legally unless you have felony or DV convictions.

That is a completely separate process than just to buy a firearm legally. Also TX is a statewide CWP process that looks like SC is as well, NC is different and allows counties to set alittle different rules like residency in the particular county. Permanent Residents are still able to get a CWP in SC if they can show their VALID Green Card showing resident status.

 if she is present in the United States under a non-immigrant visa, then she cannot purchase a firearm from an FFL, and it is also illegal under federal law for her to possess a firearm.

There are some exceptions for a person under a non-immigrant visa to possess a firearm, but these are usually limited to hunting or government purposes. If someone is a permanent resident alien attempting to attain citizenship, then they have full rights to purchase and possess a firearm, while an illegal alien can never acquire the right to purchase or possess a firearm

I would go thru the process now and test these theries by getting (for yourself) a criminal report to see if the licence for the hand gun is on there like it is in some counties and states

as it says in the post above and a few sites on internet it is illegal for non immigrant (student visa) to have a hand gun (US laws)

you need to know this when applying for the immigrant visa

I understand. The reason I mentioned that is because the OP did say he has a concealed carrying permit which I am sure he is meaning a CWP. And yes you are right. I got it back in 2014 showing both my GC and DL

Well, I am consider a resident of Texas since I’ve been living here for more than 90 days. I have a Texas drivers license, SSN etc. According to ATF.gov which is a government website I can posses a firearm (doesn’t specify) once I have a valid hunting license( which I do). I have purchased my rifle legally and am not an Ilegal. I personally called ATF and DPS to verify that i can I fact posses a firearm.

I own a rifle and not a handgun btw but I have a Concealed handgun license obviously obtained legally and the right way. As well as my hunting license is valid.

 

My fiancee is an American citizen btw. I guess I should have specified this Texas residents.

Acoording to ATF an actual government website , I can posses a fire arm with a hunting license. (Which I do have)

you did say Texaas but also said does this affect my green card so we all answered

and although you have a hand gun permit,  does not say anywhere you can own a hand gun

i was not critical i advised to check your crimianl report (do it yourself) to see if having the permit is on there

it could cause RFE / trying to save you a future problem

i know all states are different / actually all counties vary in requirements

and 5 members of my family are in law enforcement from state trouper to FBI

and i read the ATF site and the US and Texas Shield Laws 

here in TN when we buy a hand gun,  the permit is applied for at that time/ otherwise you don't have a permit without owning one

I do not know the law for Texas, no doubt similar to CO.

 

I think people are getting confused between being a LPR Resident and a State Resident.

 

Certainly in CO having a CCP would not come up on any Criminal Report, why would it?
