hi guys  my wife  tells me i dont need photos 5/5 size  to send the package to uscis   ,,,   is this right  , do  i need to send it or not  ?

No passport photo is required from the foreigner at the petition filing stage.  Passport photos of the Petitioner ARE required.  Your question doesn't indicate whether you are petitioner or foreign beneficiary.

Photo's are required for the beneficiary, I had to submit with them with the old I-130 also.

That's not what the USCIS told us when we were about to send in our I-130. We were told that a photograph had to be provided with the application. That a clip above from the current I-130 application form I don't see where it says that's it not needed if the beneficiary lives abroad. 

 

Those photo"s are not cheap especially if it's not the standard format in the beneficiarys country. The US embassy staff in Dublin send applicants to a store across the road who charge around 12 euro a photo. 

 

If a photo is not needed then it should be clearly stated in the checklist above.

The checklist is a little unsettling because it seems like photographs of the beneficiary need to be provided but the instructions say otherwise. I didn't send mine (beneficiary) in and I got my i130 approved just fine. I did contemplate being on the safe side and sending them anyway, but I also wondered how they would view it considering they said to send if I was in the United States (which I wasn't).

I was in the US for Christmas so I got some more done while I was over there, much cheaper. Although I should not have went to get them taken after a night on the beer, might get some new ones made to bring to my interview. :rolleyes:

You should get a friend to open a shop next to that 12 euro per photo shop and charge 10 euro each :D Seriously, that is crazily expensive!

They were required in the past but not now since the latest version of the I-130 was released, UNLESS THE BENEFICIARY SPOUSE IS IN THE USA AT THE TIME THE PETITION IS FILED.  Regardless of what some checklist says, the actual instructions are very clear on this.
