I-485 Cover Letter Help

Hi, I have been sketching my I-485 and it is as follows. Any feedbacks on documents that should be included?

Nature of the submission: I-485 Application to Register Permanent Residence or Adjust Status

 

Enclosed please find Form I-485 Application to Register Permanent Residence or Adjust Status, Form I-864 Affidavit of Support, Form I-131 Application for Travel Document, and Form I-765 Application for Employment Authorization and all supporting documents.

 

My eligibility is based on the family-based based category as the spouse of XXXXX, Legal Permanent Resident, and petitioner of a I-130 on filed on December 19th, 2016.

 

Attached you can find the following:

 

1.       Form I-485, Application to Register Permanent Residence or Adjust Status

Includes:

        Copy of Form 797C for Form I-130 filed on December 19th, 2016.

        2 passport style photographs taken on February 2018.

        Check in the amount of $1,225, with the combined total from fees of Form I-485 and Biometrics Services Fee, made payable to the U.S. Department of Homeland Security.

        Copy of my foreign birth certificate

        Copy of passport identity page, U.S. Visa and entry stamps.

        Form I-94 for Arrival/Departure Record

        Copy of Marriage Certificate

        Form G-1145 to request E-Notification.

 

 

2.       Form I-864, Affidavit of Support signed by XXX, Sponsor and Petitioner

Includes:

        XXX's Passport, Permanent Resident Card and Driver's License copies

        Tax Return for year 2017 copy

        Copies of sponsor’s pay stubs for several weeks

        Form 864P Poverty Guideline for year 2018.

        Copy of XXX's 2017 W-2

 

3.       Form I-131, Application for Travel Document

Includes:

        2 passport style photographs taken on February 2018.

        Copy of passport identity page, U.S. Visa and entry stamps.

        A copy of Form I-94 to show my present status in the United States

        Form G-1145 to request E-Notification.

 

4.       Form I-765, Application for Employment Authorization

Includes:

        2 passport style photographs taken on February 2018.

        A copy of Form I-94

        Copy of Passport Identity Page

        Copy of passport pages with U.S. Visa and entry stamps.

        Form G-1145 to request E-Notification.

Not sure if this is helpful or relevant to you, but I'm also currently compiling a cover letter/content list of what to send for AOS to adjust status from a K1 visa and have been seeing what else I could add to ensure a better process.

 

One thing I'm thinking about adding to this list is I see a lot of RFEs for no fee being filed with I-765/I-131, if they get separated from I-485. To avoid that possible RFE, I might include a document stating no fee enclosed because filing with I-485 and include a copy of I-485 for both. I also am considering including real certified marriage certificates with each to avoid a possible RFE requesting a certified copy. I might be going a bit overboard, but I've been sifting through common RFEs on here I'm desperate to avoid and delay the process.

its a good practice to write case no. on the top right corner just to make sure that our documents don't misplaced at some stage. I did it also,

And yes Form G-1145 of E notification should be on top.

Yes, G-1145 instructions say it goes on top, and on top it is. 

 

About the receipt Number... Do I write the receipt number of my I-130? Because I wouldn't have Receipt Number until it is filed...

About the receipt Number... Do I write the receipt number of my I-130? Because I wouldn't have Receipt Number until it is filed...

 

The receipt number should be the one from I 130. I think it's the only number we would get regarding the same case.

About the nature of submission, @QAF2A and I were figuring out the best approach for it.

 

This is QAF2A's example:

Nature of the submission: Adjustment of Status according to USCIS policy manual, volume 7, part A, Chapter 3, B,4, last paragraph. We have filed I-130 with a priority date of 01FEB17. Now in March 2018 Visa Bulletin, the chart “Dates for filing” cut-off date for F2A category is 01MAY17, and USCIS’s Adjustment of Status filing chart page[1]has decided to use this “Dates for Filing” Chart in March, 2018. Our priority date is before the cut-off date. Thus we would like to apply for adjustment of status with I-485 Application to Register Permanent Residence or Adjust of Status.

 

What do you guys think?

Based on that, and to be sure, I adjusted mine to: 

 

"Nature of the submission: I-485 Application to Register Permanent Residence or Adjust Status, accompanied by Forms I-131 and I-765.

 

My eligibility is based on the family-based based category as the spouse of XXX, Legal Permanent Resident, and petitioner of a I-130 on filed on December 19th, 2016 with receipt number WACXXXXXXXX. Given USCIS designation on May 1st, 2017 as date to be used for the Adjustment of Status, and the specifications on I-485 instructions, page 20, as well as USCIS Policy Manual's Adjustment of Status Filing Instructions detailed on Chapter 3, number 4 item C, which qualifies family-based category applicant to file this form."

Well guys, I just left my AOS package at the Post Office with a Priority 2-day envelope, return receipt and tracking number, (only because the 1-day envelope was too expensive for me).

 

I am not expecting response from USCIS until next week, but it will be a long few days until then.

I’m really curious too! Thanks for sharing! I won’t be able to submit until end of next week because my husband is traveling rn. I’ll be waiting for your feeback.
