I browsed for similar problems, but did not find the right answers readily.  My fiancee got here, and we got married etc.  we got out licence with her last name, etc.  We went to SSA and got her a number and her new card arrived in a week, with her new name.  HOWEVER, reading some other posts, it looks like we should have waited in a name change.  We went to Arizona DMV to get a simple state issued ID, and they said they can not without first having her passport changed to reflect her new surname.  We then went to one of the banks I use in order to have her added to the accounts, and again, we were told she could not be added until he has a passport changed to reflect the name that is on her her new SS card.    We are only 90 minutes out of Las Vegas, and wondered, there is a USCIS office there,  can they make some change or notation to reflect her new name or do we have to mail off to the Philippines for an all new passport for her?   Also,  we are working on filing out all the I-485 form for AOS.,  I wondered how she should sign them, or fill them out with the name on her Passport, or the name on the SS card?    Any help, advice or direction would be appreciated!

As to the requirements for obtaining these things with her "new" name compared to maiden I can't say for sure.. As for her passport, you could use the Philippine embassy in L.A. I believe it is. Here's some info:

contact Embassy of the Philippines, Washington, D.C they will be able to tell you how she can updated her passport with her new last name.

No, getting the Social Security card before marriage is perfectly fine. People sometimes have trouble trying to get any card when they wait until after getting married (because they either want it only in the married name, or they've waited over 76 days from entry and therefore no longer qualify until they get an EAD).

Dealing with the DMV is always a hassle. Each state makes their own rules for license and state ID requirements, which differ from federal evidence of lawful status. I'm a bit skeptical that they require an actual passport in her married name...more likely they need an existing (recognized) photo ID issued in the married name instead. A passport does this. So would a green card, and an EAD would likely qualify as well (varies by state again).

 

The bank thing is a little strange...you might want to shop around a little there. A copy of the marriage certificate was fine for proof of the name change for us with the local banks in my area.

Have you tried to get the Social Security card updated to the married name? This is a mixed bag of success from office to office (and even employee to employee in my experience), but so long as she has at least 14 days of legal status remaining on her K-1, she may be able to get a new card issued in the married name.

 

No, they will not change the name at a local office like that. You need to file for AOS (using the name you want to appear on the AP/EAD/green card). Then you can use the green card or EAD to get the Social Security card updated (if they won't do so now).

 

Getting a passport in the new name is another option, although I believe you need to complete the ROM first.

Yeah, she already has an SS#.  We went to my other bank to try to add her, but at least as beneficiary.  They had problems and worked for over a 1/2 hour, and then they called the home office and they told them to do a paper application.  Maybe there is a problem with her SS card ,  a temp card pending on DHS approval via the AOS.  I will know tomorrow if the account goes through.

One bank called, said come back and they will work to get her on the account in her maiden name which is fine.  I even thought of paying out a bit to have the judge issue a name change and be done with it, but we can wait.  Working on the 485 now.  One person at DMV said yes, she just needs to get a SS # first.  the next person said nope... LOL..

Good, I am glad that you have it almost figured out for your now wife. I just found it weird because we got married in NC and right away moved to CA we opened up a joint WellsFargo account for us and they didn't ask anything like they were asking for you. They just asked for her ss#, marriage license, and her passport.

 

The driving part was another issue all together because my wife didn't know how to drive before she got to the USA except for the little motorbikes. Some how she could not correlate that in to driving a car at first, so I had to teach her on the side streets in CA. But it took a 18 months after she got here to get her license and thank God we lived in a city where she could walk a lot of places or she would have gone crazy being at home all day.

My wife, texting with another K1 in Ok,  they went to a Wells fargo bank, and had no problem, and I know about the driving,  I will need to do the same!  But I wanted her to at least get a state issued ID card for the time being.
