Hello so my mother in law was just denied a travelers visa on her first try due to possible not having a business or good ties to the country? but she wa told to wait 7 months to try again. we want to wait a month or two and try again . has anyone had this happen and how long did you wait also what did you do different this time?

She can technically try anytime she wants, as soon as she wants. Generally the 'wait' time in between tries is to not "seem desperate". 

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

I would wait a MINIMUM of 6 months....and even that might not help.... Every time she is denied, it adds an entry to her record.  The only remedy for weak ties is..........stronger ties, imo.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

ok thank you thats what i thought i want to try again in three months closer to my daughters birthday but this time have much more paperwork tieing her to home

yes i understand so what else can i do to make  stronger tie ? she has an 18 daughter there who cannot come? several lands that she has workers for but to be honest i do not think she told them that as it was her first time and she was nervous

Not sure what paperwork would show ties to her home, the important information and usually the only information looked at is on the application form.

This was "unofficial" advice from the immigration attorney I hired, but she told me that there is an unwritten 'once denied, always denied' way of thinking.  Maybe it varies by consulate, I hope so.

 

Remember, under US law the consulate must assume that the applicant will overstay the visa.  You have to give enough evidence to show that presumption is wrong.

Hope you didn’t pay her too much for her poor advice. Enough evidence of people who do get approved later after an initial denial, including one here on vj who finally got approved after I think 3 denials. Circumstances change, and they do take this into account.

The first time I applied for Visa B1 , I was rejected and in the Embassy said me, I can applied in wherever moment but when I tried to obtain other date for interview the Embassy told me they cannot give appointment before 6 months due to my rejected.

 


8 months later my visa was aproved

I forget exactly what we paid her, but it was too much.  I was surprised at how easy the process really was.  Could have done it myself with help from sites like this.  But when you're in love and just can't wait...

Really for my second interview I had the same information, my situation was the same, I cannot understand why I was no approved the first time if in the first interview, They asked the same information : my work check and Bank statement where my salary is deposited, the officer  checked the amount in my work receipt and the statement bank were the same. I worked in the same company, I earn the same salary and my two interviews were with only some months of difference
