I know this has been asked before but I cannot get a straight clear answer.

I'm about to send my AOS & IV Package.

On the i864ez there are three boxes where you input the year and how much you made. I have transcripts for 2016, 2015, 2014 so thats what i included.

Today i tried to file my taxes for 2017 using turbo tax, tried to file Married filing separately but it keeps asking for my wife SSN. Long story short i have to print out the 1040 form write NRA for he SSN and send it by mail. 

Being that it will take a couple of weeks for the 2017 tax return to be actually filed by the IRS do i just send the 2016, 2015 and 2014 transcripts??? Once she goes to the interview can i give my wife the 1040 form and W2 for 2017 in case they ask for it? This is so confusing and i cant even think straight anymore with all of these things. Thanks for your help

IRS processes returns showing SSNs or ITINs in the blanks where tax forms request SSNs. IRS no longer accepts, and will not process, forms showing "SSA", 205c", "applied for", "NRA",& blanks, etc...for who will file separately.

Well this is on the 1040 from instructions.

 

If you read the actual IRS instructions for form 1040, it says 

Be sure to enter your spouse's SSN or ITIN on Form 1040. If your spouse doesn't have and isn't required to have an SSN or ITIN, enter “NRA.”

you should be ok sending in the Tax transcripts that you have now to the NVC and you could give your wife the tax transcript for the year 2017 to take to her interview. that is what I did when my wife was getting her visa. The interviewer did not ask to see the newest tax transcript . However each country is different but I still think it will be ok to do it that way

It has been a couple of years since I fill out  the I-864. After reading the instructions

you are require to submit proof of current  Income and recent tax return.

your current Income may be different then what is on your current tax return.(current tax return is 2016 now until April 15th the last day to file 2017 taxes)

When your case is approved the NVC should forward your documents to the  embassy. they will know what your current income is

Thank you for your help! And thanks to everyone else.. but I now have another question lol! I'm really sorry. NVC clearly states to send photocopies of IV documents. Can my wife scan her BC, Passport Bio Page, Police clearance etc. And I'll just print and send with the package? Or does it have to be a special copy of these items?

yes you can scan and send copies of your documents to the NVC.

For the interview at the embassy, your wife will need the originals

Returns are due April 17th. 

 

From the IRS:

 

"The filing deadline to submit 2017 tax returns is Tuesday, April 17, 2018, rather than the traditional April 15 date. In 2018, April 15 falls on a Sunday, and this would usually move the filing deadline to the following Monday – April 16. However, Emancipation Day – a legal holiday in the District of Columbia – will be observed on that Monday, which pushes the nation’s filing deadline to Tuesday, April 17, 2018. Under the tax law, legal holidays in the District of Columbia affect the filing deadline across the nation."

 

Additionally, you can file an extension.

then you will get a letter with bar code sheet of what to send to NVC "with check sheet of needed items / spouse will need latest tax returns for interview / NVC will determine which year is latest according to interview date such as the criminal report and list of doctors for medical exam

the AOS asks you to state the last 3 years of income which at this time would be 2016, 2015, and 2014

Well, if you're legally married, that is your true marital status as far as the IRS is concerned. You simply cannot file as single if you have a spouse as of the end of the tax year. However, you can still file separately from your spouse by selecting a different filing status besides "married filing jointly."

 

that would mean if spouse does not have the SS Number as out of the US,  you must follow the IRS guidelines and apply for ITIN / spouse fills out the W7 and sends to you and you enclose Marriage certificate and proof of birth (or other like a passport copy)

Well being that this is a topic where there are many opinions. I decided to go with married filing separately did it by mail filled everything in and for spouse SSN wrote NRA "NON RESIDENT ALIEN" as the instruction say on page 14 of the 1040 form instructions. It said that if spouse does not have SSN or ITIN to write NRA and file by mail. Once my wife arrives i will amend my return and file jointly. I have the 1040 form plus W2 and the certified mail receipts that i sent the documents in to the IRS in case my wife is asked for the 2017 taxes.

sorry it was the 18th last year, it always throws me off my sister and I had this conversation about 2 weeks ago she told me it was the 15th I challenged her, anyway sorry for the day off
