Employee sponsorship while on k1

Timeline

Has anyone heard if you can get employer sponsorship once you’re in the US on k1, but before adjustment of status and ead request has been submitted? A coworker of mine said her sister and brother in law did this and I’m wondering how accurate this is/was. Any information would be helpful.

Would think it would be about same amount of time anyways for the sponsorships or EAD... so.. kind of pointless... and like above, don't think you can do both anyways.

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

If the K1 does not work out an Employer sponsoring you is certainly an option,

You can get a job offer and try to expedite your EAD, but that's not sponsorship. 

So he can apply for jobs now. Even without his ead?

Right now it’s almost 4 months for ead and then  apply. He has a position lined up now, but we aren’t sure what to do about it

If he has a job offer, he can take that and use it to expedite the EAD... if you're at 4 months now probably almost finished processing now anyways though.

They would interview at their local Consulate.

My apologizes. I think we’re on two different things. We haven’t put in for the ead or the aos yet. He just came into the country a week ago and we have a few days after applying for license before we can use it. He has been offered a job and we don’t know if he can take it with out an ead.  The wait we see for the ead is 4 months. So we’ve trying to figure out options as far as work is concerned where we don’t screw up the aos, nor does he lose job offer.

Well again... you can marry, file for AOS, when you file you expedite using the job offer. Don't know how long it would cut down the wait... but again even having this company 'sponsor' him still would take time to process... and you are trying to adjust for a GC, not a work visa... so would just stay the course as originally planned. Not the only job out there I'm sure anyways.

I was always told if you were working for a Non US company and you were working for them before you filed for EAD you could keep working for them without EAD

Just when you think you have TDS eradicate,  a new case shows up.

The logistics and time required for him to obtain a work sponsorship would not be any faster than waiting for the EAD from AOS.

Is the employer willing to hire an attorney and pay the fees to sponsor him?

No, they would still need to interview abroad instead.

Yes. You can apply for jobs prior to having work authorization. That said, you cannot perform any work (even volunteer), and some employers may be reluctant to offer a job to somebody without the ability to work yet...just be sure to explain the situation to them and that there is a wait before you will be eligible to work. If they're understanding, fantastic (and many area still IMHO).

 

If you get a firm job offer, you can request an expedite for the EAD. That said, I've seen a number of expedites due to a job offer still taking months at this point. YMMV.
