Hey everyone

Here is my story: i got my B1/B2 visa years ago and i tried going to USA and booked a ticket with one stop in paris.

i reached paris but they didnt let me into the plane to usa, so i did not reach the “port of entry” which is usa

now in the ds260 form when they asked :

have you been refused a visa, been refused admission to the united states, or withdrawn your application for admission at the port of entry

i answered “no” since i did not reach usa

did i answer correctly?

if not what should i do now, thank you

Who didn’t let you board the plane? CBP or the airline.

 

If the airline then you can answer no

If cbp then answer yes

 

Sometimes the poe is actually overseas and it is cbp overseas that prevent you from boarding then yes it does class as refused or withdrawn entry. One example is Vancouver Canada, CBP screen you as you board the plane and once in the us it is like you landed on a domestic flight as you have already been through immigration.

Greetings!

 

I have not known anyone that was not allowed to board in the plane going to his or her destination, especially when the visa was issued earlier. Only the US Custom Board and Protection Officers can do that at any US port of entry. Unless one gets wild and fight inside the plane then the Captian of the plane will have to ask you to be removed from the flight. Please elaborate. Did you not ask why? This is new!

Well he said he is from the US marshal.. he then said that he made a mistake by not letting me board and that he is very sorry for this mistake .. thats what happened and that is why i answered no ..

what do you think i should do? :/

It happens, if the airline has reason to believe that the person isn’t eligible to enter the US they are obliged to decline boarding otherwise they are required to provide a flight back and they hate doing that. If they let someone in without a valid visa then they could also be fined and they really hate that.

Well that’s a new one on me. Did you ask for ID? did the people at the gate or check in desk seem to recognize that he was an official?

I know.. trust me i am peacful person 😂😂 .. well i had my DHS redress number with me and everything was great .. when i was getting ready to enter the plane .. someone from the US marshal came and asked me to step back, he took my passport and croosed my visa.

i gave him the DHS letter with the redress number, he appologized and said he made a mistake , he called washington and asked them to let me on the plane and they said that this is not possible since he crossed the visa . He apologized again and asked me to admit for a visa again.

that is the whole story

what do you think i shouldve answered?

I know this is weird but it happened :/ ..

I have read this from one forum (reference:http://www.airliners.net/forum/viewtopic.php?t=406719 )" This is one reason why airlines check your immigration credentials into the US pretty carefully at check-in (even before Sept 11, 2001) -- the airline has an economic incentive not to transport people who will be denied entry, and therefore go home on the airline's nickel".
 And of course, you could not get in without a valid visa.

Did they try to explain to you what you were missing or even explain to you?

This is a very tough call. Technically you were denied as he called and asked for permission for you to go in even though he wrote on the visa and they said no but alternatively he shouldn’t have crossed it out in the first place. Personally I would have ticked yes, I would tell them at the interview what happened but be prepared that they have already made up their mind.

 

Why did you think you would need it, most people once they get their visa don’t assume that there will be problems getting in so don’t go see a lawyer once they have their visa in hand.

When you go to the interview they will most likely ask what happened with your visa being cancelled I would tell them that you answered no to the other question as it wasn’t at poe and explain what happened with the air Marshall.

they can stop you and put you on a plane back home if your country required a visa or transit visa to pass through

at the airport in Agadir Morocco (it was just posted in January on here) they did not let a man on the plane as he had no transit visa to change planes in  Sweden
