you can file, if there is a balance owed there is no need to pay it right away, IF you know for a fact that when adding your spouse it will result in a refund as this will cancel out any penalty for not paying on time.

 

you then file an amended form and mail all the proper documents in.

Once i file since i will be filing by mail. At the time of her interview will the 1040 from and W2 be sufficient as i wont have a transcript? Now that i will submit the AOS Package do i have to include the 2017 return or can i use the 2016 which i have the transcript for? since i will be sendin the package next week technically the most recent tax info i have will still be 2016 correct?

you can file for free online turbotax and have all things filed by efile and be able to print off a copy that way. you can also use turbotax to file the ameneded return.

The problem with turbo tax is that it keeps asking for my wife SSN and obviously she does not have one. I was suggested to input and dummy SSN to allow me to continue and at the end choose file by mail, print the forms, erase the dummy SSN and write "NRA" and mail it in. So at the end im able to print a 1040 form with all the info so my question was would my wife be able to take this to the interview in case they need the 2017 taxes?

Yes, you can take the signed copy along with any W2s and 1099s to the interview.

 

And as you said, you cannot efile without a valid SSN or ITIN for your wife even if you are filing as Married Filing Separately

you need to have original or certified copies from the issuing agency, this would result in those papers being mailed back, so the most efficient way to apply for ITIN is if he has his wife's actual passport and she has signed and filed out the W7, they must have the wet copy of this, again resulting in a very expensive mailing from the home country.

 

I had my husband passport brought back with a friend, and the completed w7 also I mailed these off to texas to ITIN operations only for the USPS to lose the 2 day priority package that had a tracking number, it hasn't been moved or scanned since the 13th of Feb.

 

it would be much better for him to file MFS, and then not pay and do an amended return when the spouse has gotten the ssn.

i married in 2010 and applied 2011 with my 2010 returns and they assigned ITIN

and he did not get his visa until 2015

just a matter of filing out the W7,  providing a marriage certificate and proof of ID/birth of bene

actually was quite easy as i had all documents from applying for the visa

i had copy of passport but used his birth cerificate for proof / you have to have these to apply

and from morocco only $35 to mail a 4 day letter but when i originally went to Morocco i had a POA signed by my husband 

also i had the application with me and we did it together since it has a place you need to fill out in Arabic

i cut out all that stupid mailing back and forth

you dont mail to ITIN, you mail with tax retuns

they must have updated since you did it last, as you have to mail the W7 down with the tax return and now will only accept an original certified copy from the issuing agency, I tried to take it into a CAA they refused to accept anything other than the original papers, or a certified copy from the placed that issued it. and you have to mail your tax return down to the ITIN operations center in Texas, once they fill in the ITIN they prepare the tax return.

and it did take longer to get my return back so since they had originals they might have fowarded them / i just helped a Moroccan do this with tax returns and i hope no issues as she is waiting for the W7 to be mailed back

I had the W7 filled out and he sent it back to me with all the papers I requested, when I went to call IRS to set up an appointment was told that he had to be here to get an ITIN, if he was here, he would have had a SSN with no need for an ITIN they didn't understand that apparently.

 

I went to a CAA and at all the office in my state and was denied at all of them, they wanted to do the taxes and application for me, all I needed was them to sign off they saw the original documents, all refused. so I was forced to mail out his passport with the signed tax return and it has since be lost, I have had to file a congregational inquiry with my senators office. I can't get anyone on the phone from ITIN to even acknowledge they received the mail, which I am hoping is the case but still need confirmation and can't get anyone at the IRS to assist with it.

 

now my husbands passport is gone, he will have to file to get a new one, I dont know where all my tax information is at, and it take the IRS 8-10 weeks to give an ITIN and to complete the taxes, by that time tax deadline has passed and I am between a rock and a hard place.
