Hello Folks,

 

Anyone have experience with tourist visa out of Manila to USA?  My fiance lives in Manila. She would like to visit USA to visit her mother and sister. Yes I would like to visit with her while she is here. At this point She meets all the requirements for Tourist Visa. She thinks a trip to HongHong would help her even more. She has a child she will leave with relatives, She has a business with a business licence. She has money in the Bank.  I plan to file the K 1 visa  around the time her tourist visa would be approved.  We are both Keenly aware of the law reguarding people on tourist visa getting married without going through the K1 visa process. Neither of us will consider  doing anything illegal. We dont want to cause problems with the K1.  She will carry a copy of the law with her if questioned at the border to reassure the officer that her intent is a visit. Nothing more.

Any Ideas?

From what I have seen on here having a mother, sister, and fiancé in the US will work against her. Additionally they may see you as being used to circumvent the long wait for adult children and siblings wait time.

 

How did the mother and sister come to be in the US, if they used tourist visa and then adjusted status they might think she will do the same. 

 

Having a child won’t really help as is normal for her fellow countrymen to leave even very young children behind when emigrating. 

 

Having a business can be a tie but it depends what it is such as if its a business she can manage from anywhere in the world as opposed to something that needs here there to continue and even then if she is intending to come for a long visit then it can’t be much of a tie that she can leave for extended amounts of time. 

 

Having an established travel history showing that she returns when required to will help but ultimately the embassy is required to assume that she will have immigrant intent, this is doubled by having you there and already having plans to get a fiancée visa.

 

She might have to wait to see them once she comes over on the fiancée visa.

Spend the $160 and give it a try....

I’d say give it a go, seems she is prepared on what she needs to bring for the interview. Be forthcoming but at the same time, no need to disclose information that is unsolicited. She can try again if she fails this go round, and the denial/approval will not affect her future immigrant visa application. good luck

I don't think a trip to Hong Kong will help.

 

I say spend $160 and wait for her denial.....

Just when you think you have TDS eradicate,  a new case shows up.
