I entered on foot by the San Ysidro border crossing with a B2 Visa and told the officer I was going to the shopping outlets just outside the Border like less than 1 mile. I eventually made my way to San Francisco and have been here for 5 months , I checked the CBP site and don't see they issue  me an I-94, I told the officer I would just be going shopping. I want to go back to Mexico as I don't want to stay illegally in the country but I am afraid I won't be left back in. Any ideas on how I should exit by land at the San Ysidro CA border crossing again ? I think US CBP does not check who goes into Mexico so they won't know when I exited.

 

i must also say I had a baby in the USA came and want to return maybe in 5 or 6 months time after I exit, but being I already would have spent 5 + months in the USA might look funny to CBP when I try to come back in. But my thinking is that since I said I was going for day shopping and they don't check my exit I can say I left the same day without them knowing i actually flew to San Francisco and stayed 5 months.

 

what are your thoughts???

Untruthfulness with CBP is never a wise thing to do.....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You are correct that the US does not have exit controls but does Mexico have entrance controls?  Will they stamp your passport or other entrance documents the day you arrive?

Yes they do stamp your passport.. so I could use that to show I left the country within my six months.. I am just afraid that when I try to re-enter they may deny me as l plan to be outside the country for a couple months...

The general guideline is you stay OUTSIDE the US twice as long as you are in the US. If you were here 5 months that doesn't sound like you were a tourist. Do the right thing and file the proper visa, K1,  CR1, H1B, whatever your case may be, and live here legally. Many of us have separations from the ones we love, but it's the legal and right way

Entry into the United States is never guaranteed unless you are a citizen.....visiting the United States is a privilege........if you abuse that privilege or try to "game" the system, you will regret it.......play by the rules or lose it!!
