Priority Dates for Family-Sponsored Preference Cases

For family-sponsored immigrants, the priority date is the date that the Form I-130, Petition for Alien Relative, or in certain instances the Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, is properly filed with USCIS.

Embarrassing.. I thought I had it figured out but apparently not. Anyone have any advice? I thought priority dates pertained to work type visas.

K-1 doesn't have a PD in the normal sense since it is not an immigrant visa

For all questions regarding Manila Embassy you will find it a lot better to post those questions in the Philippines Regional forum as you will get the correct answer as it relates to Manila versus the General K-1 forum

Thanks for the tip. I appreciate it. I searched and found others had the same issue and the answer was to use your acceptance date on your NOA1 as for K visa the priority date is irrelevant/not applicable.

The funny thing is that on the US Embassy in Phils site fiance visa is listed as an Immigrant visa. Also on the traveldocs website to set the interview as shown in the pics.

I dont understand why its different. 5a932bbc20e39_immigrantvisa2.thumb.jpg.18c97d805d82e153cfb1ec036c10fc76.jpg5a9329d10528b_immigrantvisa.thumb.jpg.bd04ba0ff94b56b7b7368a1d003d5e5b.jpgIt gets confusing with this kind of misinformation out there.

It's not a funny thing but a decision made by the State Department to interview the K-1 in the immigrant visa unit, as compared to the non immigrant visa unit...  Has always been this way

Country-specific thread is moved from the K-1 Process forum to the Philippines regional forum.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hello everyone.

I am trying to fill out our profile on the embassy interview scheduling site and it is asking for a priority date. I dont have a clue... Anyone help me out here?

You got it figured out I see, just the same the PD is the RECEIVED DATE on the NOA1.  K-1 can use any date, as mentioned by others it isn't used with the K-1, even though it is processed as an immigrant visa (reason being it has immigration intent)

May be some helpful info here:  http://www.visaconnection-philippines.com/k-1-visa-application.html

The K-1 process is quite strange. For a time, it is both a non immigrant and immigrant visa type. That is why the links send you the process for immigrant which would be the I-864 even though it truly is a non immigrant visa requiring I-134. As you go through the stages, within the NVC system you look up your file under immigrant. It stays that way until after approval and ready for issue. At that point, it changes over to non -immigrant. It truly is a non immigrant visa with immigrant intent.

I agree also with Hank's explanation.

With NVC they do treat the K-1 separate from the immigrant visa,  NVC has a separate phone number for the K-1 to call .. listed with the below info.

You will receive your case file number (MNL) from NVC once they have reviewed your file.

After you receive the NOA2 (I-797 Notice Of Action) in the mail it can be another 2-4 weeks for NVC to get your file from USCIS and into their system, then a 2-6 more weeks before NVC assigns the MNL # from USEM.

Call after 4:45 PM or early at 7:05 AM eastern time, M-F, for shorter wait times.

K-1 are processed like an immigrant visa, but are NOT immigrant visas, so they fall into a completely different class of their own.

K-1 visa:  1-603-334-0888 Operator assistance is available Monday through Friday from 7:00 AM to 12:00 AM (Eastern Time) .
