CR1 POE after being married for 2 years

Timeline

I entered the US a week ago with CR1. On here I have read that I would be eligible for the 10 year visa since we had been married for more than 2 years when I entered the country. At the boarder control they did not say that that would be the case. The lady who gave me my passport back said I should ask from the USCIS. 

Any advice who to contact and when? Before they issue my GC? Or am I not eligible for the 10 year visa after all?

If you have been married for more than 2 years when you arrive with your spouse visa you will/should get a 10-year green card (not a 10-year visa). The POE staff have nothing to do with issuing green cards so the advice for people in your situation is to wait and see what arrives in the mail. It should be a 10-year green card. If it is, wonderful. If not, you can get them to correct it. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Timeline

people at the border are there to parole you in. they check and see if you have the appropriate visa to come in. they dont know how visas work or issue them.  therefore, they do not know if you will get a 2 year conditional or 10 year.

 

however, you crossed after married for 2 years with a CR1 therefore, USCIS will issue you the 10 year. if they make a mistake and give you a 2 year then you have to make an info pass and correct it.

yes girl you will be fine! i think people do not understand that border patrol just approves your entry and your greencard comes from someone else lol its a very confusing process for sure!

Incorrect, if a 2 year card was issued to someone who is entitled to a 10 year card, the person would need to file an I-90 with no fee and submit that along with the incorrect card in order to have the proper one issued.

September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

They don't issue visas but the CBP are not idiots, they are well versed in how everything works

They should be, but sometimes they don't even open and keep the sealed envelope.  People sometimes forget what they have been trained to do.
