I-864 Affidavit of Support question

Hey guys,

 

My wife (USC petitioner ) and I (beneficiary) are in the process of currently gathering everything together ready for our AOS from my F1 status. My wife is a PhD student with a yearly stipend paid monthly from her school so meets the poverty guidelines for income. Even though she meets the income requirements, her most recent IRS form shows just under (2016), as she started the PhD that year and therefore only received the pay from Aug-Dec of 2016. Obviously we will send in the IRS form from 2016, the most recent tax year. She has her W-2 for 2017 which shows her income for the entire year, can we send this W-2 form for 2017 and the most recent tax return from the IRS (2016)? Is this sufficient? If not, what else is needed?

04/02/18 - Biometrics appointment @ Field Office

04/16/18 - Courtesy letter received re: Medical

07/17/18 - EAD card in production, AP approved

07/21/18  - Combo card in hand

10/18/18 - GC Interview  (Approved on the spot)

If you send the 2016 tax return, you risk getting a request for the 2017 tax return since your application will not be processed for some months......When do you plan to file 2017 taxes?

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

She usually does her own taxes with her dad, so probably around Easter time she may file. But we won't get the IRS tax form until a lot later, right?

You simply make a copy of the tax form before you send it to the IRS.

I've seen RFEs when there's only a W2. It's like they think you forgot to send the tax return that goes with it. Can she get something from the Graduate Studies Dean's office detailing her yearly stipend...used like an employer letter. Better yet, use this need to get motivated to start the taxes.

Okay, thank you! I'll get her to get her W2 and do her taxes, hopefully!
