yes my petitioner is legally divorced.. and he is going to apply my k1 visa on 19th January..

But is He just recently divorced? When did he get his divorce decree?

I think, but I'm not sure because I've never been married to get divorced, that as long as the divorce decree is dated and legal before you send the petition in it should be fine?

 

You may be subject to extra scrutiny but they're only looking to see that you're free to marry each other.

 

**of course it may also depend where the divorce is taking place, whether there are any laws that state you have a period where you're not allowed to marry within a certain period after divorce.

 

I'm not 100% sure, I don't want to give you wrong information...@-@

Yes you are right.. their is a period after a divorce. You can’t  marry him/ her at that period....but I’ll confirm you.

Thank you, I got divorced in Tucson Az, and it does not say in the divorce decree to wait for certain amount of time before i can get married again. I hope everything will be fine. I trust God will guide us. God bless us all.

My petitioner divorced in LA. And the US law is he cant marry in that duration..

Looks like it varies state to state, but Arizona has no waiting period.

Our lawyer mailed in our I-129F packet in on January 12th, should be arriving at USCIS today, January 16th. But our lawyer already forget to include my fiancée's proof of american citizenship and said that she was already working on sending it in along with form I-94 which she also didn't send stating that it was not necessary, even though it's listed as one of the required documents (I was in the US for a year under a scholarship). Should I already expect to receive a Request For Evidence later on or will they just receive the two packets and put it into our file? Has anyone ever heard of a similar situation?

I think there's a high chance it will get lost if it is sent in before you get the RFE. I've seen a lot of recommendations that people wait for the RFE to come before sending additional information, for that reason.

 

I would expect to receive an RFE later on.

We followed up with USPS tracking our package that we sent out on Friday January 12, 2018.  

 

On the website it shows that our package was delivered this morning.  How often do they check this lockbox? And should we expect an NOA1 via e-mail/text right by the end of this month the very latest?  We filled out the G-1145 form so this should speed up notifications for the I-129F right?

My attorney sent in my 129(f) and I received the NOA1 in the mail today, 1-16-2018.  The received date is 1-08-2018 and the notice date is 1-10-2018.  I put the received date down in my timeline.

However, on the envelope from USCIS it says it came from the California Service Center. I am a Maryland resident so I thought my case would be processed out of Texas.  Not that it makes any difference to me, it was more of me being curious.  My attorney is located in California so maybe that has something to do with it?  Thanks and lets hope they speed this process up a bit for everyone's sake!

Give it two week at least before worrying.  And unfortunately g-1145 does not speed up anything, it is just to tell them to inform you through email or text, but they're not that good with informing people lately. So first give a few weeks.

All k1 cases goes to California service center.

As being sad before, don't send anything unless an rfe comes to you (in this case it will come) so get ready your documents to send in order to answer really quick when it comes.
