01/18/2018: Text message with NOA1 info and case number received

01/26/2018: NOA1 Hard Copy

07/27/2018: NOA2 Received :jest:

08/14/2018: NVC Received, Case & Invoice # assigned

08/21/2018: Case in Transit

08/24/2018: Naples Embassy Received (case READY)

09/04/2018: Packet 3 (received after sending them an email inquiring about the Packet)

09/18/2018: Interview, AP 

10/2/2018: Out of AP, Visa Issued

10/4/2018: Visa in Hand

I read recently from an Australian consulate review, that a beneficiary was able to complete their medical exam prior to receiving the NOA2. I was under the impression that medical exams could not be scheduled until NOA2 was received. Does anyone know anything about this?

Hello everyone! Here is a fun way to pass the time! My fiance is reading incorrect information on the internet lol. Can we do a post about misconceptions? He told me that he read that he cannot go back to Lima Peru until 1 year after he is granted access to live and marry me in Chicago. Is that true? It could not possibly be right?

Yes and no. Here's what I can offer; others feel free to correct/add:

 

- K-1 visa is valid for a one-time entry, up to 90 days. Within that 90-day period, the petitioner and visa holder must marry to be eligible to retain status, or the visa holder must leave the US.

- After marriage, file for adjustment of status (I-485) to retain legal status while the adjustment is pending approval. You may also concurrently file for advance parole (I-131) to seek permission to leave and re-enter the US while the I-485 is pending; typical processing time is approximately 3 months. Leaving the US while the I-485 is pending without advance parole will be treated as abandonment of the I-485 and any legal status. Note that advance parole itself does not guarantee re-admission, but leaving without advance parole almost certainly guarantees that you won't be able to return without a new immigrant visa.

- Upon approval of the I-485 (which may take one year or more), a green card (permanent resident card) will be issued (possibly for only a 2-year validity, depending on how much time has elapsed since the marriage). The green card can be used to re-enter the US, assuming it has not expired and you are not judged to have abandoned your permanent residence status by remaining outside of the US for too long.

Okay, this makes sense. So, once he arrives in the US and we get married, then we file for the i-485 (and i-131) to follow the legal protocol. While we are waiting for the results of these forms we are not able to go visit his family in Lima.

He only needs to wait for his I-131 (advance parole) to be approved and in hand before he can leave the US; the I-485 will likely remain pending for much longer. The advance parole document is a permit issued to non-citizens without permanent residency to re-enter the US after traveling abroad (actual admissibility, as always, is determined by CBP inspection at a port of entry).
