Definitely, Not sure whether or not this is your situation but as someone who also came from the same country, when through some of the same struggles I would recommend, enjoy your time in BR and although I know it is hard to think about it now, you will sure miss once you are here. Family members and friends....take this time while you are still waiting to create more memories with them. :)

8/16/17 --- AOS Packet received Chicago USCIS Day 0

8/21/17  --- Received email & text notification 

8/23/17  --- Received hard copy of NOA  

9/01/17  --- Biometrics letter notice for I-485 & I-765 & I-131  

9/11/17  --- Biometrics Appointment Done

10/17/17 - Case Is Ready To Be Scheduled For An Interview

11/30/2017 - EAD/AP Approved
12/01/2017 - Card in Production
12/05/2017 - Received Approval Notice in the Mail

Yeah my fiancée keeps telling me to enjoy my time here but it's really hard. We've been dating for almost 5 years now and we're just mentally and emotionally drained. So now I just want to make more memories with her.

 

The last time we saw each other was in the beginning of January and ill only see her again when I go for the visa interview or when I arrive in the US. 

 

And on top of that I don't have much to do here in Brazil so that doesn't help at all lol. It's like my life is on hold until I get there.

 

But hopefully things will get better after we receive our NoA2 and see that things are finally moving along.

Hello January filers,

 

Since USCIS is taking long to process everything, I'm trying to see how to take advantage of time and possibilities within USCIS.

 

So I have a question that maybe someone experienced like @Naes ,@x_driven_x and @John & Rose will be able to help. But all of you are welcome to help. And I believe this will be helpful to all.

 

So it's seems like USCIS is taking a long time for process the lifting conditions (I-751) since CSC is still processing November 2016 cases. So is it possible for us to file I-751 before our two year conditional permanent resident conditions are over? For example, could we file a year in advance since we know it's taking so long? That way, when an adjudicator has the petition in hands, the two years will be fulfilled. Or can we only file the I-751 90 days before our two year anniversary as a conditional resident?

No.  you should apply with the 90 day rule (90 day before your green card expires or more like before second anniversary of residency..)

as you know one of the reasons k1 gets a conditional green card or even why CR1 exists (CR1(conditional resident) unlike IR1 (immediate relative) is given to couples who are married for less than 2 years at the time of petition approval. Same rule apply.

Yeah I read that information. I was just thinking that maybe we could file even before the 90 days since it's taking more than a year and a half to process the lifting conditions. We're gonna end up having the I-751 and N-400 application ongoing at the same time then lol.

 

But I asked because I've heard of people doing something similar with the two year homestay requirement. That is, I thought I needed a waiver of the two years or had to wait two years before filing. But it seems like it's possible to apply for the k-1 even before receiving the waiver or completing the two years. The waiver or fulfilment of the two years is only required at the time of the actual interview. So the adjudicator will adjudicate your petition without the waiver of the two years. That’s Because the eligibility of the beneficiary only matters at the embassy level and has nothing to do with the uscis.(in cases of waivers for k1)

 

think about who files a waiver waiver with a k1 petition? It would be the petitioner. If for example he/she applied more than twice etc. so petition is all about the petitioner. Who applies the visa then? Beneficiary/applicant so the waivers of beneficiary would appear at that level.

But it's funny how USCIS let's you file for naturalization even before getting the permanent green card. At least that's good 😀

That’s because of the eligibility criteria.

Roc criteria states you need to be married for 2 years. Naturalization states you need to be resident for 3 years. So we are eventually paying for something that we will never have because they are slow....

 

(which I’m also happy that we can apply naturalization if we want to-however they will still hold gc interview before or together with naturalization even at these cases)

We thought it was a 3-6 month process too! We applied before finding Visa Journey so imagine our shock seeing the times now :/ But we will get there! We had set a date for a wedding and begun planning (we won’t lose money though if we need to change date). Again this was all before VJ. We just thought we were being generous thinking POE by end of Summer so we could do a ceremony early November :rolleyes::whistle::jest: if we have to change (likely) I know we will be okay. It will suck. But, this is making us all stronger... as hard as it is, it is making our relationships stronger with our fiance’s. Another week is done and dusted, another week gone so another closer to being with our loved ones.

Hey so are we tracking at average processing time of 194 to 201 days? My estimate tracker is up about close to 2 weeks now over the last few weeks and i know some people are getting approved in 160 days and some over 200 so i know its only an estimate but just trying to understand the average or better yet Mode of the data.

You can use the timeline search and then search by visa type and NOA1 dates and it will show you the data VJ knows about along with average.

We also didn't realise exactly how long this thing would take when we filed.

I am kind of wishing we went CR1 route, as well. But it is what it is! There will be an end to this :)

 

I haven't got the police check, but thinking maybe organising it around July. I'm also in two minds which one to get since there are two and appears either seem to be accepted?

I have been to my doctor to check on vaccinations but haven't done anything else. I was supposed to pick up a prescription for either Hep A or C (or B?) One that you need a 6 month booster so we thought if I got that sooner that would be helpful but the prescription is several hours north (I won't get back there till August probably unless they post) so I'm wondering if I should just wait till the medical exam anyway since the vaxx are more for AOS (correct?) but probably cheaper doing it now? Anyway, that's my ramble LOL. I haven't been to the US since filing sadly. And he hasn't been able to come out either. :(

No type of Hep is required for vaccination on people aged between 19-65 (not for k1 not for AOS either)... you should check required vaccines, you may be overvaccinating yourself.

I’ll have to find the website that told me all the vaxx you’d needed but maybe it was more general! I’ll look into it more. Thanks @Naes
