I have done an advanced search before posting. My dilemma, I am due to apply for N400 online tomorrow, however today I received my approval letter for ROC.  I am wondering if I can still apply for N400 without the physical card, or should I wait around 2 to 3 weeks for my GC? If I was to apply tomorrow for N400 and submit the approval letter, would this confuse/delay my application. 

 

I guess I am delighted to finally get my approval but kind of confused as what to do next, because I was so looking forward to the last leg of my journey. I have spoken to a couple of people who advise me to wait, but I was wondering has anyone found themselves in the same situation or am I the first?

Well, like you I got my approval letter few days after I'm eligible to apply for N400. I did wait for 3 weeks to get my GC before I applied online for N400 because like you I was concern for delays and RFE. Were on the last step so I think its better to have GC on hand because that is one of the vital requirement. Anyway the process depends on the field office and not on the giant VSC/CSC

Personal opinion, I think waiting 2-3 weeks for the 10 year GC is what I'd do. 

I personally don't think the 2-3 weeks is gonna be much difference anyway (since the whole process can take up to a year depending on where you are). 

I didn't file for my N400 right when my window opened, I took my time and filed about 2 months later. 

 

PS. I got my 10 year GC about 12 days after the approval, so it shouldn't really take up to 3 weeks.

Thank you ,I am going to wait now. Probably because my friends say so and the other reason is I am not quite prepared with documents any way. I love this forum because of people like you who share knowledge and because there are so many kind people too. :)

Hi! I am new here and this will be my first post. I am looking for any info about my situation. I filed my ROC on March 13 2017 in California Service Center,  had my biometrics last April 7 2017 and thats the last time I heard or did something. As what I checked they're still processing the Sept 2016 filers, this big delay is making me anxious and I dont know what to expect and what to do next. I am supposed to be eligible to file for naturalization next month. Question is, can I apply for naturalization even if I dont have any update from my ROC or I really have to wait for my greencard? Thanks in advance.

Congratulations.

It is a physical card - your status is what matters and that is now fine and unrestricted, and you are eligible for N-400 filing, so why wait? 

Depending on your state of residence, waiting three or four weeks or whatever at the moment could be the difference between being a citizen in time to vote in the mid terms.

 

Just upload a scan of your long expired 2yr card - which shows your 'resident from' date, or if you don't have an old scan of it then the approval letter with a brief explanation.

 Don't forget that when filing the N-400 online there is the option in your account to upload further documents after submission.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Thank you!  I  didn't realise that I could apply and then add further documents after submission, i thought I would have to take them to interview with me, as we haven't done our tax returns for this year yet. My field office is pretty quick for N400 than some other field offices. I do have scan of my expired card, I made a copy when I first received it.  I didn't even think about the voting aspect, but good to bear in mind.  I shall concentrate on the online submission today, I hear its quite long.  Once again thank you for that information. :)
