I have an 0-1 visa. I just got married to an American citizen. Filling out form i-130, part 5: Have you EVER previously filed a petition for this beneficiary or any other alien? My husband was the owner of a business that was my sponsor on my current O-1 visa. Is the answer Yes or No?

They are asking if he has ever petitioned as an individual not as a shareholder of a business.

I have had several O-1 visas only, just got married and am now applying as an alien Relative. In filling out form i-130, Part 4, #10: Has anyone else ever filed a petition for the beneficiary? Do my previous O-1 visas count as a 'Petition'?

Yes, in order to receive an O-1 you need to have been petitioned for (I-129)

The I-130 is for the petitioner (USC) to complete, not the beneficiary.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Your posts are confusing. Please do not start multiple threads asking essentially the same question or variations thereof. Also you are posting in the DCF section but your embassy is listed as Ireland, which doesn’t offer DCF. To keep the forums tidy and to keep your threads in the correct section, please let me know what your situation is. Are you in the US applying for adjustment of status from O-1 or are you outside the USA applying for a CR-1?

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas
