Work Visa - Visitor Visa

First of all greetings to everyone reading!

This is my first time posting or leaving my own country and I have a very limited idea of what I need to actually to or even search on this forum so I'm just going to start a new topic. If anyone knows where I should look feel free to direct me there.

 

I started dating a woman in america online and I've decided to travel there to be with her for a few weeks so we initially decided to just get me a visitor visa (Or whatever it's called) for the little get together. A few things changed with us and we decided to try and get me a work visa instead. Her parents (All of whom are US citizens) have offered me a job at their company and can "Sponsor" me (I have no idea what that means)

 

What steps should I take towards successfully getting a work visa and heading to america?

 

So far I'm aware of the passport requirements and I'm working towards that.

P.S: I'm told there are different kinds of Visa's for different positions. The position I've been offered is in a air conditioning company. They manufacture and sell air conditioning equipment so I don't know if that helps.

This would be likely be something best suited for their company's lawyer to address.

 

In general, the company does the hardest part of petitioning for the position (including all fees for that part) and such. Only after that would you apply for a visa, show that you meet the requirements for it, etc. ETA is impossible to tell without knowing what visa exactly they are looking to do...it could be weeks or months or more.

Timeline

  What type of work do you do ?   For some there is no possible route to a work visa.   A visitors visa may be hard to get because you have to show reasons that you must return home.    What would make you return to wherever you are from ?  

This will not be over quickly. You will not enjoy this.

The requirements for each visa type differ, so one may be easier (or harder) in your circumstances than another. For instance, a tourist visa requires showing intent to return home, whereas an H-1B does not have any such requirement (but does have other education and work requirements that don't apply to a tourist visa).

 

If you want to visit, then apply for a tourist visa. Good luck! If you later decide to work, you can pursue that process later. So long as you are honest with all steps of the process, a refusal won't hurt the other.

question: have your potential in-laws ever sponsored anyone else for employment before? It’s not as simple as some seem to think, especially if it’s a back-door way to get a relative (or potential family member as in your case)

in any case, you’ve never met this girl, probably better to start off with a tourist visa and see how things go from there, than decide to uproot your life ...because it’s also clear that your job would be dependent on your relationship...suggest take it slowly. If it works, great, then explore further options.

I think it would be better for you to go visit them first, see if you like each other in person and everything is legit. 

 

The work visa might take a long time to pan out and you might not like it or feel comfortable when you meet. 

 

H1B visas are for professionals with BA and even MA degrees. If you are simply working in a job in an air conditioning company that does not require this, then H1B is not for you. Plus, so many people apply that there is a lottery for it.

You can't get a work visa for this. The employers are clearly biased in the hiring process (obvious conflict of interests). You should apply for B2 (visitor) visa instead. (Or, if you are Indian, you can apply with Indian outsourcing IT companies before the loophole closes.)

01/07/2017 (Saturday!) EAD/AP renewal package with new forms received in Phoenix "reception desk"
01/17/2017 EAD/AP renewal case accepted; text/email with receipt numbers was received
01/30/2017 Law firm finally confirms that USCIS has suspended processing all EB2-NIW cases due to new criteria. 
02/23/2017 USCIS slowly starts adjudicating NIW cases again.
04/21/2017 Extended EAD/AP received in mail. Valid for 2 years. 
05/06/2017 Received a massive RFE on I-140 NIW case.
07/20/2017 RFE response received by USCIS (a very long response with 30 pages of docs)
09/14/2017 I-140 NIW approved!!! 
11/28/2017 RFE for new medical issued (plus another request re Supp J for employment which is clearly issued in error)
12/04/2017 RFE received in mail
12/07/2017 repeated medical exam for I-485
12/08/2017 Attorney receives documents for responding to I-485 RFE

Visitors Visa is much simpler and cheaper to get.

 

Work Visa, nothing to comment on, have a chat with the Company Lawyer handling the case, let us know what visa etc they are looking to apply for.

It's not as simple as knowing someone who is willing to give you a job. The job must meet certain requirements to ensure that the local labor market is protected. Hence most jobs that qualify for work visas are for graduates or people with very specialist skills. You can't get a work visa to come here to answer the phone or drive the van. There are plenty of unemployed locals who could do that. 

 

It also costs the company a lot of money to bring a worker into the country. For the likes of Microsoft and Google it's change out of the back pocket, for a small Mom and a Pop business it could be the equivalent of several months of revenue.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

so the company offering you a job does the forms and fees etc ...
