The appropriate route for BRINGING A FIANCE INTO THE USA FOR MARRIAGE is K-1 or CR-1.

Senior Master Sergeant, US Air Force- Retired (after 20+ years)- Missile Systems Maintenance & Titan 2 ICBM Launch Crew Duty (200+ Alert tours)

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The lawyer is pretending the situation is something else than it really is. Have other people done it? Yes. Is it strictly legal? No. Do you want to play loose with the rules under the current administration?

He can enter, marry you, go back home & wait for his spouse visa.

When he turns up at the POE and is asked for purpose of visit, make sure he tells the truth, to get married and stay in the USA. He will quickly find out if your lawyer was right or wrong.

Why can't he enter the country, marry you, then return to his country while the appropriate visa is being processed???  It is legal for him to make short visits during the process.

Can you answer this question:  Why can't he enter the country, marry you, then return to his country while the appropriate visa is being processed??

His job....that you want him to leave at the drop of a hat anyway?!

 

actually, what do you expect him to do in the US under what will be a best case scenario for you, if he does just “suddenly decide” to stay, of months without his being able to work or travel? Will he be ok with that? Isolated from everything he knows and totally dependent on you? And then what if uscis gets picky about the visa fraud bit?

 

If you really can’t be apart, and want to do it legally, marry him, and go live with him while you wait for his spouse visa to be processed.

The fact that you plan to propose and expect him to stay and adjust is fraud. Stop trying to skip lines and do it the legal way.
