Leasing office lost lease

Timeline

I am putting together our package for ROC. I moved into his apartment in 2015 and was added to his lease and we have evidence of that. The leasing office has managed to lose the lease renewal for 2015-2016 but has the other ones. They did give us a "Resident Charges/Payments Ledger" showing both our names and rent payments and attached a standard piece of paper about how to get information about residents. Will this be enough? Apparently, they told my husband they don't usually give affidavits so I am not counting on that happening.

You will be fine.  I didn't  have a joint lease with my husband nor was I on the mortgage or such. I sent my package with no joint bills, no joint mortgage/rent because our life together and circumstances dictated we couldnt do that. I enclosed a covering letter regarding this and if that's not enough for them, then there is absolutely nothing I can do about it. I can't manifest something out of thin air unfortunately. I don't know if I will get an RFE or a interview or such, but what I do know is that you have clear evidence of a joint residential/marital home together. Please try not to fret, although I know this harder said than done.

Wait why in the world are you telling someone you will be fine BEFORE you got approved. 

 

We know you cant manifiest commingling of finances and Im not going to say you will get deported, but what you mentioned is EXACTLY how you get an RFE, then possibly intent to deny then possibly court order, then possibly deportation. USCIS can not know whats in your heart when it comes to love, they only know that those that love each other go above and beyond to produce certain paperwork to prove their unconditional love. While I dont like to scare people, I also dont like people like you to come here and tell others theyll be fine if they submit nothing while YOU DIDNT EVEN GET APPROVED YET

I would attach what you have and in your covering letter, explain what happened.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Because I actually watch cases similar and have for a year now. Deportation and such now who is trying to scare who. RFE I have been expecting or an interview. I'm am trying to give reassurance to this person and I've seen plenty of people with less approved, what are you doing, apart from spreading your nastiness?

Nobody is spreading nastiness, deportation is a reality and LAW if you cant prove your marriage is real. 

 

You didnt even tell the person what you included in your letter as an explanation for why you dont have a lease. While they are fine for missing a year, not having joint lease can be very problematic for people.

Congrats, but I also know this is the internet and I should take everything with a grain of salt. 

 

You're an adult, act like it, its not a competition, even if you got approved without commingling of finances, no one is going to see your post and decide to go against USCIS guidelines on what they expect to see with an application. 

 

To the rest reading, continue collecting as much evidence as you can.

I am not going to waste my energy on this conversation. I prefer to remain positive and my positive attitude has seen me through this journey with no RFE's thus far.   If you don't mind I shall leave you to your negative comments and enjoy my approval letter.

Thank you guys. I attached what I have and sent it in yesterday. It is what it is, can't send in something I don't have and hopefully we have enough of other evidence of co-mingling that they will be happy and approve us.

Absolutely you can only send what you have!! It's not just about the rent agreement, they take into account all other co mingling evidence. As you know I didn't have rent/mortgage or any utility bills in my name. We did have a joint bank account that really was rarely used, money was some times transferred from my husbands other account. I guess the thing that got us through was the fact I was on his medical, tax returns and we sent receipts in of such things like buying a dishwasher in my name, plus letters addressed to me at the house, letters addressed to him at the same address, medical bills, photographs together and a couple of affidavits (only 2 if memory serves me correct). The main thing, which is important is I did was write a cover letter and explain the situation and today I was approved with no rfe nor interview. 

 

 Good luck and I hope you don't wait too long for your approval!

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

My ROC window is coming up in April, I am hoping we have enough evidence. I would like your input on it please if you dont mind.

What we have:

- Joint Car ownership
- Joint Auto Insurance
- Joint Chequing account, 1+ year of transaction history
- Pictures from family vacations, possibly airline tickets if we have find them
- We are on the same phone plan together with my wife's parents on it aswell (mother in law's plan)
- New Jersey Drivers licences showing the same address

Thats pretty much it, we do not have a lease in our names because its in my mother in law's name, shes leasing the place for us. Do we need a letter explaining this?

Is it too late to open up a joint credit card or put me as a user on my wifes existing credit cards?

Tax returns are important do you have them?. You know something, I didn't even have a driving licence, no insurance. What I sent was a joint account, but the joint account was not really active. I sent every receipt from my husband over the years, he is an accountant.

 

I sent mail received by him at the same address, mail to me, cards, credit card bills (we don't have a joint credit card bill). I sent me on his medical insurance and all medical bills. receipts. I did not send life insurance although I am on it , there is no statement, however you can send a window shot of it, if no statement. I sent pictures lots of pictures of our family at Christmas, airline tickets. 

 

I sent 10lbs of evidence, none of a joint mortgage, rent nor utility bills. I can't do that if I am not on them.  

 

What else did we send? Hmm, tax returns, medical bills, cards from my family and friends, joint Christmas cards, his mail, my mail, photos ,  receipts for workmen I paid for and a dishwasher  and just normal every day life things. 

 

So you have so much more than I did. However, what I did do was write a cover letter, explaining our situation without going into the personal reasons. Had they asked with an RFE I would have explained our situation in more detail.  Did I expect a RFE, yes I did and that is transparent in my old posts,  an interview crossed my mind, but you know what,  they are not stupid people at the USCIS ,they tend to know a genuine case when they see one and they DO read that cover letter. You will be fine, I got told off for that today for saying that, but hey ho, I know your case  is genuine and I am not a USCIS representative. Good luck.

We dont have any tax returns, we were kind of being supported by our families during this whole process to help us get our things together. My wife was in school and I started work just recently (I am the beneficiary)

I do not have medical insurance but my wife is on her mothers plan.

So you're saying that sending mail that we both receive to the same address qualifies as evidence? even though both our names do not appear on the same pieces of mail?

Thats why I am including copies of our drivers licences with the same address, as you have to prove to the Motor Vehicle Commission that you received mail to that address and we both did.
