I send my 130 for my spouse on Feb 16 and it was delivered on feb 21, 2018.

 

seems I did little bit mistake

I130 for page 1 part 1,

question 3 I checked No

 then on part 4 21a I put my info but on 25 a I left blank thought it was asking for beneficiary children and she doesn't have any children

 

please let me know whats going to happen

 

what to do now?

at most they will send you a RFE, and they might not.  

 

All you can do is wait.

just spoke with USCIS rep over the phone my packet is delivered by usps  but its not in their system yet.

 

and she told me to wait 10 days from the date of delivery for the notification. if the application is incomplete then she told me they will send it back and I have to do new one...

 

is that correct...

 

but otherwise I have filled out everything just in 2 places I realize I did mistake

in question 3 if you are petition for spouse it should be no, as the petitioner your information would go in part 4 21 A as you are the only spouse

 

it should have been filled out in 25 as well....so you are only having 1 mistake and that is not filing out question 25

this person is your spouse, in mine I marked no in question 3 also

 

21ABC is the beneficiary spouse that is you so putting your information there is correct

 

 

25ABC-28 should have all been your information as well, now if they consider that to be incomplete application or not you will just have to wait.

I am worried as you know if there is RFE then the process becomes longer

if they consider it to be an incomplete application they will send the entire pack back to you and you will have to fill out and refile, if they send it back they will also send the payment back.

so just keep an eye out if the payment was cashed or not.

not always, you could still end up with a RFE later down the road, right now all you can do is sit and wait, if the check gets cashed you can breath a bit easier, did you include 2 passport style photos of both you and your spouse?

there are the things I included with the application

 

  1. A check for the amount of $535.00 to cover the filing fee;

  2. Form I-130 Petition for Alien Relative;

  3. Form I-130A, Supplemental Information for Spouse Beneficiary, for the beneficiary;

  4. Two (2) photos of the petitioner and two (2) photos of the beneficiary;

  5. Petitioner’s biographical page of passport ;

  6. Divorce decrees of petitioner;

  7. Marriage certificate of petitioner and beneficiary;

    8. Evidence of bona fide marriage.

    9. Form G-1145 e-Notification of Application

I submitted the same, I also included pictures from relationship, and of wedding day, and I submitted, affidavits from family and friends I had a PD 5/8/17 and was approved 1/17/18 so pending the application being accepted you should be fine

 

I didn't submit the bio page of passport so much as I did submit my birth certificate copy instead

You did it right . Part 4 -21.a . Your info.

 

25.a i dont think it would be an issue. If they request evidence or want you to submit a new one . Use N/A for letters . And NONE for numbers . Dont leave it blank . I believe you are gonna be fine .
