I filed the i-120 for a replacement i-94 so that we can do the adjustment of status, and I now realize that I did not submit a copy of his passport (stupid I know).

 

What should I do? Any chance they will accept it? Can I send them that now, or do I need to wait for them to deny it? I don't want to have to send another check for $445 and have them cash both of them.

That process will take longer. You can go online on cbp (see attach photos) and fill in the info from his passport and the requested info on the website. After which they will provide his I-94 record for free and you can print it after without waiting months for the replacement.
