Well this is interesting story. I was involved with Filipino 38 months ago, we got engaged, i supported her /her family (grandma) for 38 months. We got legal Civil married in December 2017. I went back Last week to see her and coming back on airport, one of her friend send me info which is very interesting. She will be kicked out from Apartment next week too, she will have no place to live or financially support, i was the only one, others are just using her to have good time, and she is using them too.

 

This girl has been sleeping with many many guys and she is with this guy for over year and some others too (!!) while they all is still living there. This guy exposed me all the truth about her with pics /screen shots, telling she lied him too. 

Just got married and was collecting all papers for K1 visa. She was just going to keep me until next month, when she will be graduating. She is no interest coming here, she wants to be with many guys ! 

 

Now I have to Divorce her after finding all these. How to file divorce in USA and send her notice etc. ?  

 

If some has this kind of case, let me know, how to proceed with Divorce and legally terminate Philippine marriage instead of going there and annual which is painful procedure.

She can't file for divorce since she lives in Philippines.

 

If she was able to leave Philippines and goes to USA or Hong Kong and files for divorce,  The Philippines will not recognize her as being divorced.  She would never be able to marry unless she does an annulment.

 

If you file for divorce then she could remarry in the future in the Philippines. 

 

The ball is in your court so to say,  If you want to pursue legal charges against her for adultery she would be arrested and have to bail out.  Then since you pressed charges she can go to court, or she can make cash settlement with you to have charges dropped.

Just when you think you have TDS eradicate,  a new case shows up.

You need to file for a divorce in accordance with the process and procedures in your state. This is typically where a divorce attorney is used. Doing this by yourself is possible, but usually not suggested.

 

Once finalized, if you want the divorce recognized in the Philippines, you need to take it to the court. It's still a fairly long and decently expensive process...easier than an annulment, though. That said, unless there is a compelling reason, having it recognized in the Philippines isn't necessary. Let her deal with having the divorce recognized there if she wants.

Thanks you all, she has no money to file divorce or to get by, i was giving almost average $ 1000 allowances for school, living food and her basic shopping, her grandma's maid, her medical and many other needs. 

At this point, i am just trying to find healing of heart. In last weekend even we were meeting wedding planner for big reception after her graduation (civil marriage is already done)

 

I think i will go for adultery case ( i have pics and screen shot what she wrote to other guy about their sex experience love making all) (amazingly she screwed that Ausi guy so thats how whole thing is revealed to me by Ausi Guy)

Wow she is supposed lucky to you , giving allowance etc ,and you marry her already , then she doing that ti you or maybe you dont know each other ,, then u married 

 

anyway  divorced depends on circumstances here in phils iknow  about only annulment .. or maybe we have but expensive??

A divorce between a Filipino national and foreign national can be recognized in the Philippines via court if initiated by the foreign national.

There is also a legal divorce in the Philippines for certain Muslims in specific circumstances.

A foreigner can initiate the divorce in their home country and it will be recognized in that country. This can allow him to find someone else better and petition her.

I thought that if the marriage is done IN the Philippines then the Philippine government will not recognize a foreign divorce decree. Correct me if I am wrong please sir.

 

Also USEM says that they will ONLY honor a Sharia divorce if the marriage was done through Sharia court as well.

Yes, that is my understanding as well. That is also a requirement. :)

 

Correct. There are various requirements for a Sharia-based divorce to be recognized (not just by USEM).

Well he said that they got a civil marriage done IN the Philippines so the Philippines will not recognize a divorce na through a foreign government only a annulment.

I have always heard and been told if the petitioner is US Citizen, Doesn't matter if they were married in Philippines or abroad, the Philippines Government will recognize the divorce. 

Just when you think you have TDS eradicate,  a new case shows up.

Did he? I read that he got civilly married but didn't say where explicitly so I wasn't sure.

Actually, you may be right here. I have to admit that I've heard both (even from the same source!), but I thought it it depended on what was considered a "mixed marriage". Having the marriage within the Philippines doesn't actually matter there after some more in depth reading, so I think you are right. Good to know.
