Hello, I have questions regarding COS I-539 from F-1. I had my OPT until 7/1/2017. Then, I enrolled to school to maintain my F-1 status. However, I was involved in a lawsuit so I was not able to focus on school. After I discussed with DSO, I filed I-539 on 8/30/2017 then dropped the school. 

 

I checked my status from USCIS and showing my case is Approved. This is my first time to file I-539 for status change.

 

Here are my questions:

 

1) People say that I must leave the state before my I-94 is expired. I checked my I-94 and doesn't show the date but "D/S". How would I know the departure date? Will USCIS send me a new I-94 with a departure date?

 

2) People also say that I have 6 months to stay. How can I determine 6 months? I filed I-539 on 8/30/2017 and approved 2/16/2018. Do I need to leave 6 months from 8/30 or 2/16?

You changed to visitor status and was approved, your application would have included how long you wanted to stay Part 3 Question 1a, what did you ask for?

Hello Boiler,

 

Thank you for your answer. When I filed I-593, I asked help for the duration of stay. I was advised not to put exact date because I was in middle of lawsuit.

 

"On Form I-539, Part 3, 1a it asks for the end date we are requesting for an extension of status. Your application was for a change of status, not an extension of status, so this was not necessary to fill in."

 

This is the answer I received it. That's why I do not know exact date I need to leave.

D/S was for your F1, I assume you have not had a response to your B.

 

I have not heard of someone leaving the date they want the CoS blank,  assuming you are granted a CoS I would assume it would be good for 6 months.
