My girlfriend is in Colombia and I am filling out the paperwork so she can get a K1 Fiance Visa and I can marry her here.

 

A couple years ago her Mom visited the United States with a travel visa and never returned.

 

Obviously I don't want to lie on the form and also I don't want to prevent us from helping her Mom down the road.

 

My girlfriend is super worried about saying that her Mom is in the US when she shouldn't be for fear that questions might be asked and action might be taken against her Mom.

 

What is our best option?

It wont affect nothing . USCIS I doubt will use any resources to go after her mom ..... its always better not to lie

He or she who is untruthful to immigration authorities will usually live to regret his or her lies later......Tell the truth....period.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Hate to say again, the truth is always the best.

 

One, worrying about "covering" for someone breaking the laws of the US already should be least of you concerns in this process.

 

Besides, 3-4+ years from now, if reform can be done, won't be a parent category to "assist" her with later on anyways.

Tell the truth, lying to immigration is not a good idea and not the start to your married life you should be having. 

 

They wont go after her based on this, and from people have said they weren’t even asked but when people have lied it has been an issue.

 

Her moms situation is not her responsibility, she can only do right by her own situation and that is by telling the truth on all forms relating to her own immigration. Her mom has to deal with hers.

 

I know it seems harsh but I have seen so many kids and young people carry the burden of guilt and responsibility for their parents immigration situation and it really isn’t fair.

It is very sweet your girlfriend is worried about screwing something for her mom. Her mom certainly has not thought about screwing something for the daughter…

 

At our interview the beneficiary has been asked if she had any relatives in the United States. Your girlfriend is right about worrying that her mom situation may come up.

 

Her mom’s overstay is most certainly in the database. Whether they will look up or match her mom’s record… that I cannot tell. I agree with everybody else that honesty is the best policy.

The question simply asks where the parent resides, not their legal status. No one at USCIS is going to bother checking up on her parents, most importantly because without more details, it's almost impossible for them to confirm that they're looking at the right person's status in the US.  

They ask name, date of birth, place of birth and city/country of residence - good luck to ANYONE to identify someone within reasonable doubt based on that, without even full address details.
