Yep...could not wait any longer given the latest Processing Times update on 5/24.  Just unacceptable!

Well, as you can see, lots of people are applying, and lots of people are applying, and lots of people are also applying... It'll get far worse before, or if, it gets better.

My CV to USCIS is already drawn up and ready to be shipped off To Whom It May Concern.  My employer is Gov't, and absolutely will not tolerate or permit any kind of even potentially unauthorized employment.  Naturally, having held TNs for a few years, I completely recognize and respect the restrictions that come with TNs.  The effect of not getting my EAD in time will be catastrophic (mortgage payment, car payment, health and other insurances, no longer allowed to drive, can't pay any monthly expenses, and on and on and on).  I am the primary income earner, and we literally will be facing homelessness without my ability to work.

if I were you, I'd tone it down a bit... You don't have to by any means, but I would write something along the lines of:

To whom it may concern,

My name is Northerndynasty, and I am the beneficiary of the Adjustment of Status application, case number MSC###.  I am currently employed by Gov't on TN status, which expires on August X, 2019, and after which Gov't will not be able to continue to employ me without valid employment authorization.  I respectfully request that my Employment Authorization Document (MSC###) be expedited to ensure that I can continue my employment without interruption.

I am a valuable member of the Gov't ABC team, as is evidenced by the letter from Gov't, dated X, attached to this package.

In addition, not being able to continue my employment after the expiration of my current status will cause severe financial loss to me and my family.  My household depends on the income from my job, as my spouse is currently <XYZ>, which is not enough to cover existing expenses.  In support of this, please find attached:

- a recent mortgage payment, to which my salary contributes X%

- a recent auto payment, to which my salary contrbutes Y%

- our family health insurance plan, provided by my employer

- recent insurance and utility bills, to which my salary contributes Z%

As well as our most recent tax return, showing the breakdown of income for me and my spouse.  <and any other additional documentation you wish to provide>.

Personally, I feel that describing what you're providing as evidence and why, is more important than tugging on their heartstrings about how you'll be literally homeless otherwise.

Quote

I have the W2s, Tax Transcripts/1040's, and pictures of my PP/TN auth stamp, D/L, etc.  Like you, I agree with MORE info than what is necessary, but it certainly goes to supporting your justification.

Thanks for your best wishes; I can only hope!  Time is ticking away very, VERY quickly.....

I personally included all of that, but yeah, technically you don't have to.  My reasoning is, the officer reviewing my expedite case has to find my I765, and all the evidence that goes with it to make sure it's in order.  They also have to dig up my I485 to make sure that's in order.  So I submitted the marriage certificate (why I have the I485) and all I765 documentation, so they can find the form itself, look at the evidence, and call it even.

Oh I meant the shipping status for USPS shows its in acceptance. It says coming from USCIS- LEES SUMMIT PRODUCTION FACILITY.

Very frustrating.

Nice, we're hoping to go back to my country for a weekend if it gets here on time, I'm just surprised at how fast they're shipping it since it just updated yesterday to Card being produced. :)

I just reentered the country on my AP last night - into DFW as my poe.

DFW is going through a transition to the automated machines, and we landed at 1830, which meant that there were about 6 kiosks open with CBP agents. I waited for about 30minutes in the "other visa/non ESTA" line. There were a LOT of people behind me.

I got called back for secondary inspection (which is the norm), which lasted about 5 minutes, got the passport parole stamp and was on my way. Was a lot easier than when I was on an F1 visa - I didnt feel like I was being judged.

One thing I will say is that the US has now done away with the customs slip, and as an AoS applicant, we do not need to fill this out anymore. I was unsure, and the workers in the hall kept saying I needed to go to the ESTA machine and get a slip - even though I do not / we do not need an ESTA. I was worried I would have to finish the line and then go and get more documentation - but I did not.

I travelled with a lot of paperwork. Passport / EAD AP Combo Card / NOAs for EAD AP Combo Card / NOA for i485 / Marriage License.

I presented my passport, and the Combo card. The agent asked what my reason for AoS & parole was, which was marriage. I then went back into the secondary room, and was through bags in hand in about 45mins.

According to a tier 2 officer, they have 30 business days to respond to requests. That's actually 6 weeks. It's pretty normal not to hear anything after faxing evidence. If you call and ask for Tier 2 they *might* be helpful, but likely no one will be able to confirm whether they received the evidence. It's all very frustrating.  I sent my fax twice just in case but still didn't hear anything, and it's been 5 weeks.

Thank you for the information! Hoping we both get good news soon! Today is four weeks from when I first submitted the expedite request so hoping to hear back in the next couple of weeks. I also reached out to my congressman, we'll see if that helps at all

Seems like the Expedite request is just as useless, as is evident by the waits both of you are on.

I’m riding an official USCIS Expedite AND “inquiry” by my Congresswoman (since they can’t officially ask for an Expedite), and i won’t be surprised if I don’t hear anything for as long as it would’ve taken without asking.  What a sham!

Hi guys,

I am experiencing some trouble in my EAD expedite request and in 1 month my extension will be over - which would result in losing my job... Hope you will be able to help me with the following.

I will start first with the facts:

  • We called USCIS May 15th and a Tier-2 officer said he will try to expedite my EAD and that we should hear something in 30 days (I was a little bit surprised that he did not request a reason - such as severe financial loss-  but he said he was not needing it as i was over the 8.5 months EAD regular timeline)
  • Then the 21 this is what shows up on USCIS site in my case history:
  1. On May 21, 2019, your request to have your case expedited, referral number XXX, was assigned to an officer for response"
  2.  On May 21, 2019, we sent a response to your request to have your case expedited, referral number XXXX.
  3.  On May 21, 2019, your request to have your case expedited, referral number XXX, was completed."

As 9 days after i did not receive any response by mail or e-mail like they are mentioning, we called USCIS - spoke to Tier-1 officer (Tier 2 being unable to respond to all the calls) -  and he told me a letter was sent  to me, asking to fax supporting documentation. I never received this letter though.

Then my questions here are:

- Is it possible that the expedite EAD request is just being processed without asking supporting documentation (like the officer seemed to say the May 15th) - and maybe that is why I never received the letter? In this case I should just wait...

- More realistically, do you think I should call USCIS again (trying to reach out  to Tier-2) to have them resend the letter ? I tried to have them sent it by e-mail but USCIS does not seem able to do that. Also, they recommended me to raise a e-request for that, which I did - but doubt it will help...

I don't want to involve Congressmen or Senator as this stage as long as I am not 100% sure USCIS is asking supporting documentation, and I get this letter.

Thank you so much for  your help!

Hi Guys,

I am new to this thread and need some guidance from people who have been through the expedited process.

I am a March 2019 AOS/AP/EAD filer, from a K1. I have had my biometrics done (in Hartford CT). I also have my social security number and full driving license.

I desperately need my AP.  I have called USCIS and requested consideration for them to expedite it. Then a tier 2 officer called me back and said that she would send me an E Mail and have NBC contact me to proceed with my request.

This evening I have contacted my local congresswoman and asked if she can help in any way with the process.

Any tips or advance?

Hey there! If I were you, I'd probably call USCIS again and ask them to resend the letter. Since you are over the 8.5 months processing time, then maybe it is possible that they're processing it without supporting documentation but if they also told you they sent you a letter then it's likely that they asked for something. Regardless, with USCIS it doesn't help to be as clear and demanding as possible lol. Honestly, given that you have passed that 8.5 months mark, I would consider contacting your senator. Doesn't matter if you do or do not know whether USCIS is asking for more information, the senator's office's job is to file an inquiry for you when you cannot get a timely response to your USCIS application, as is your case. Also keep in mind, that it might take a few days for the senator's office to get back to you, then they'll ask you to send the a privacy release form. All that can take a few days if not a couple of weeks and since you said that you only have about a month left before you lose your job, those days count (I learned the hard way - I waited to contact my senator and had to quit my job in the meantime). In short, I would call both USCIS and contact your senator at the same time and follow through with that they tell you. Good luck and hope you get good news soon!!

Hey there fellow Marchie! It seems that you've taken all the right steps to file an expedite request. When I filed mine with USCIS they told me it can take five business days for them to send you that email asking for supporting evidence. When did you call them?

Your congresswoman's office is probably going to ask you to send a privacy release form, after which they can contact USCIS about your case. You could also try reaching out to your Senator. Personally, I had better luck getting an answer from my senator than my representative / congressman so no harm in trying both :)

And I also have another job that wants to hire me but I can’t accept it bc of my work permit they reached out to congresswoman to see if she can help expedite...  have a current EAD through DACA... sent AOS application 4/15/19 received 4/16/19 . here’s my timeline . 5/1/19 expedite request sent

5/8/19 evidence requested  (financial loss, termination letter from job)

5/9/19 biometrics done-early walk in

5/10/19 faxed termination letter, cover page explaining my severe financial loss and how I have school loans and just have a baby this past January and have bills.

5/17/19 USCIS received evidence for expedite request

and have not heard anything since ... I’m so nervous and stressed.

i have another job offer they really want me to work with them and they had me do a privacy release form and sent it over to our congresswoman to see if she will help expedite it as well I’m not sure when or if she has contacted USCIS on my behalf yet but faxed over info on 5/24/19 to her secretary.... still have no updates since 5/17/19... I feel your pain (in a different scenario - not DACA, but with an upcoming expiring work authorization).  Why not pick up the phone and call USCIS and ask for Tier2 to get a follow-up?

congresswoman did most of my work so I really recommend you work with one.

What a dream! My husband submitted an expedite request for his EAD on 04/23 and has not heard a thing (severe financial loss due to loss of job offer and single family income). We spoke to a tier 2 rep this morning, who told us that the wait time can take up to 30 days or more depending on the officer it is assigned to. We checked our case status this evening and found an ugly RFE request for his I-485 application. Very sad considering we’ve filed numerous forms (for his K-1 visa) without a single RFE... it feels like we experienced a major setback. We inquired about the i-765 and have action on the i-485? Weird... and unfortunate since his i-765 is halted.
