Same boat as you, faxed last Monday morning. Still nothing. This is sucks ....

My P.D. is 3.1.19 and I completed biometrics already. I asked the Congressman office to help me submit an expedite request for EAD and AP on 3/22 with a company letter. 

 

I am still seeing fingerprint review was completed. Is that normal? I don't see anything about expediting in my I-765 case history either.

 

Basically, I have a OPT EAD which is set to expire in late June. So I will lose employment if this new EAD does not come in and the reason for expedite is financial loss to company I believe

Financial loss to company? Not to you? And you're not even sure? Did you write a cover letter? 

 

And do you know that your congressman's office actually submitted the expedite, have you followed up with them?

Financial loss to company as I will lose employment in 2 months if I don’t receive the new EAD.

 

I did not write any cover letter. I only wrote a paragraph explaining how it would be a financial loss to the company if I lose employment when I submit the service request to the congressman office.

Well, several potential issues here. 

 

You'd have to be pretty important to the company for them to suffer financial loss by not having you around. I hope their letter clarified the severe monetary loss if you were absent. Like, if you're their top sales person and without you the millions dollars of contracts will disappear. 

 

This is why everyone here applies on the criteria of severe financial loss to person (you). You not having income is pretty serious to you, but your company will usually just replace you. 

 

Not having a cover letter is a poor choice. The paragraph you wrote was just for the congressman's office? Your reasoning is already potentially invalid, not explaining in a proper cover letter is a mistake. 

 

Do you know if your congressman submitted anything at all? Have you spoken to them? I ask because, when I expedited my EAD, I also asked my congressman at the same time to do the same. His offer sent me a letter two months after my expedite was already approved, basically asking, "what is this?"

 

If I were you, I'd tell the congressman's office to forget about it, redo the expedite, do it yourself, and then also ask them again with an updated package for good measure. But if you truly believe your company will face potential bankruptcy or otherwise "severe" financial loss, then I guess keep going with that.

Oh wow. You have a good point. I am honestly not sure if the congressman office did submit the request for me or not given that there is nothing in my case history related to expedite.

Yep. 

 

Read your letter from your employer. What does it say? Normally, it'd be pretty generic. Mine said, "eckoin worked for us since X, as a Y, on Z status. She's great and we'd like to keep it this way, so please expedite her EAD so we can keep her on a permanent basis if she gets her LPR status."

 

My cover letter explained that our household bills are dependent on this job since my husband recently started a business, and also I like having medical insurance. Your reasoning is yours--do you have bills to pay? Is this a career growth thing, where losing this opportunity stunts your future potential? Did you move to a new apartment and it costs more money? Whatever is the reason why this is a financial loss to you without the job. 

 

Call USCIS, ask to expedite, choose the criteria, AND make sure to explain why this is a financial loss to you when asked. If you don't explain properly that you have a job, you can't continue it without EAD, and you'll suffer the following financial loss, it'll be denied as soon as an IO reads it. 

 

Frankly, I feel like I've written this out on this thread at least half a dozen times. You should go back and read some of it.

well this morning i got a text and was super excited it'd finally be an EAD Approval (I faxed my evidence a week ago Monday) but it was the old USCIS site saying that my 1-485 is ready to be scheduled for an interview. I wonder if that means they just reviewed my I-485 application to make sure my I-765 is in order to approve? I really hope they aren't denying my EAD expedite assuming i'll just get my I-485 approved soonish because our FO takes forever to actually schedule the I-485 interview ... so that could be months.

Hi everyone,

 

I'd like to give you information about my expedite process so you can have an idea of how long everything is taking/what you get notifications for etc. 

03/21/2019: Requested to have AP and EAD expedited on the phone to USCIS (separate processes). AP of the grounds of "humanitarian reasons" due to my university graduation ceremony and a culturally significant role that my mother was taking part in during the ceremony. EAD due to a job offer and "severe financial hardship" due to obligatory student loan repayments in my home country.

03/21/2019: Received email: "Upon receipt of your request for expeditious processing, your case was reviewed and a determination was made that we need additional information to make a decision regarding your request. Please fax supporting documentation to 816-251-2290. Please include this notice with your fax." This only mentioned the EAD request, so I was unsure if AP was also being considered at the same time. Faxed documents that afternoon. I included a cover letter outlining everything that was included in the fax (I combined documents for both AP and EAD). DID NOT RECEIVE NOTIFICATION THAT FAXED DOCUMENTS WERE RECEIVED. I called USCIS a few days later to ask whether I would, they said I wouldn't heard anything unless the expedite was approved or denied. 

 

03/27/2019: Received "New card ordered" notification via email (and assumed approval). Did not receive official letters on this until a few days later and therefore not totally sure that both AP and EAD were approved. 

 

04/01/2019: Received "We mailed your new card" notification via email. 

 

04/02/2019: Received "Your card was picked up by the post office" notification via email complete with USPS tracking number.

 

04/03/2019: Card was delivered to my lawyer's office. Picked up the combination AP/EAD card in person on 04/05/2019. 

 

Hope that helps you guys with an expected timeframe, etc. My process seems to have been quite fast and straightforward. Although we have been using an immigration lawyer with all our forms, I submitted the expedite process myself on the phone. Let me know if you have any questions.

I waited and on Friday, the DHS site says My card is ordered even though MyUSCIS still says Fingerprint is completed. I think the congressman did the trick!

 

I had followed up the congressman office on Wednesday and they said that they got a response from USCIS saying that I would get a decision within one month.

For future readers - I still do not recommend the "severe financial loss to company" route, as far more people have been rejected than approved. But in the end, whatever does the trick is what matters. Happy working OP!
