Timeline

Anyone has an update on their request for expedition? I tried to get a hold of a tier 2 officer but was always put into a queue and absolutely no-one called me back. When can I put in another request for expedition again?

21 February 2018- Visa Issued                                                  16 Nov 2018 - EAD Approved                                                                             

23 February 2018-Visa in hand                                                  24 Nov 2018 - EAD/AP received in mail

20 March 2018 -POE: Los Angeles                                            26 Nov 2018 - SSN mail received 

20 May 2018-Marriage                                                                06 Nov 2018 - Interview Scheduled

Is there someone here that was/is in the same situation and can help?:

 

I entered on a B2 visitor visa on December 2013. Was married but never filed AOS, divorce finalized January 2017  AND

I got married 2nd time on September 2018.

Sent AOS PD 12/20/18, did biometrics on 01/03/19

Can I request to expedite  EAD  based on the fact that I've been in the US for 5 years and didn't work, I don't have a drivers license (and I need ssn to get one in Arizona). We currently live with my husband's dad as we moved states 6 months ago and my husband just started a job a month and a half ago making 45k LESS than he was making before (he was a defense contractor and couldn't be in a relationship with me due to his security clearance so he quit).

Please and thanks in advance for any advice.

AoS Timeline:

12/12/18 Mailed AoS + EAD + AP

12/14/18 Package delivered at Chicago Lockbox

12/20/18 Text notifications received 

12/24/18 NOA1 received 

12/31/18 Biometrics Appointment letter received. Scheduled for 1/9/19

01/03/19 Biometrics walk-in done

06/18/19 Interview was scheduled

You can't expedite based on the fact that you haven't worked for five years nor based on the fact that you need a driver's license. Neither qualifies for severe financial loss. Your husband taking a different job is also independent of whether or not you have an EAD

2018-06-25: Mailed I-485, I-864, I-130/I-130A, and I-765 to USCIS

2018-07-24: Biometrics appointment

2018-08-28: Expedite request submitted for EAD via USCIS support line

The irony of the story? It's so easy to work illegally but very hard to do otherwise.

I wouldn't say hard. That's the process, and all immigration is really a privilege, not a right. It's not any person's fault that they were born in country A and not B, but there needs to be some sort of process. It's just... lengthy. But I suppose it makes sense, though I personally see no reason for EAD to not be granted automatically for every AOS application once the background check clears. If it's a fraudulent application, and someone just wanted to work in the US for a few months before their application was denied, power to them. They pay taxes and they do a job. I see nothing wrong, but it's my personal opinion and nothing else. 

 

I wouldn't say it's easy to work illegally; you're quite limited in job options and there are plenty of opportunities for abuses of employment laws, since an illegal worker doesn't have much recourse. Chances are, the under the table job isn't as great as a legal job. The employer knows that.

You Should try and find a job, job offer and your financial situation can be a good case.

I Guess after 60 days they will create another request. L2 officer should be able to guide you on the timelines of that

Senator had to follow up again, Senator's office told me this time they reached out to USCIS over the phone and got a specific response about my case from them.

 

Anyways I'm super happy....Yippppy!!!! 😎

 

I would suggest don't lose hope, continuous follow-ups and patience is the key, provided you have a genuine reason to convince USCIS and Senator/congressman 

 

Here is my updated timeline 

 

08/27  - Filed for AOS/EAD along with 485 at MSC

10/29 - Requested expedite 
11/13 - Got letter asking additional evidence 
11/15 - Faxed all the  details 
11/16 - Senator followed up  

12/17 - Senator followed up again (via phone)

12/19 - Got specific response from USCIS (not the generic one)

12/28 - Status Changed to "New Card is being produced" (MSC is super crazy even my expedite request took 2 months 🙄even holidays during my timeline may have added up the days)

I don't think there is a call back option, you gotta wait until u get someone from L2, I would say call early morning that's the best time to reach to L2 officers

Weird. In my case, L1 said they would transfer my call to L2, then an automated answering machine would put me into a queue so that someone will call me back. That's it. I never had an option to even wait for an L2 officer.

That's strange, I have talked to L2 about 3 times and all the times i was on hold and transferred over, BTW i was calling the number listed on my USCIS letter asking more evidence.
