Hello All,

My PD is Sept-27 and I just did biometrics this morning. I am currently working under OPT which expires on Nov-20 so I really need to expedite the EAD so I can continue my employment. Can I request an expedite request now or I should wait a couple of days after the biometrics? Please advise.

Thanks,

I'd say give it a day and then expedite. It usually takes the biometrics 24 hours to be in the database.

You may need your employer to provide a letter of notice saying if you don't have your new EAD by Nov-20, you will be terminated.

The expedition request may still take more than a month to be completed. Consult with your employer to see if they would like to rehire you if your new EAD arrives after Nov 20.

I faxed the job offer on Thursday and today the I-131 status changed to “document was mailed to you”. Any idea why? I didn’t request to have the I-131 expedited.

Thank you! Called USCIS this morning to speak with a L2 officer and she put on a service request for me. Hope I will hear back from them soon since my work permit expired on August 17 and next week my driver license will be expired :(

Waiting for my EAD card, hope it will not take too long since my Expedite request took almost 2 months to be completed, below is my timeline

Called for Expedite request on August 23, reason: H1B expired on August 17, financial lost for myself and my company - small company, case assigned on August 27
Faxed docs on August 31
Case assigned on September 6th
Congressman involved October 1 to follow up, said Case is under reviewed.
October 11th, Called Customer service L2 officer, put on service request to check status but they did it as an expedite request, received email request to fax evidence (again?) on October 15th.
Asked Congressman office to submit evidence to USCIS. They did on Oct 17, and case updated to be routed to expedite, etc.
Oct 20th, Card in production.

My Congressman’s office submitted a request on my behalf on October 18 and today they received this email from USCIS:

Thank you for your inquiry regarding this constituent’s immigration matter.  We have requested the file and it will be reviewed by an officer once we receive the file.  Your constituent should receive a decision or notice of other action within 30 days of the date of this notice.

Did any of you get the same update? How long from now should I expect my approval?

I called to their office, talked to the person who incharges of dealing with USCIS. That person gave me her email, I sent her release form and everything I sent to USCIS. She then sent follow up for me. I recommend to have them involve after you receive the request to submit evidence. Ask them to submit evidence to USCIS. They have special power.

This morning I got an email from USCIS saying:

“We received your documents in support of your request to expedite the decision on your application. Your case is currently under review. You will receive a decision or notice of further action shortly.”

And the online status of the I-765 got another update saying:

“On October 24, 2018, your request to have your case expedited, referral number T1****MSC, was completed.”

Did any of you get that email? How long was “shortly”?

Have you faxed proof yet? In got 2 successions of 3 messages like the last one. The first one was on October 18 when they emailed me requesting proof. The second was today when they reviewed my evidence and hopefully made a decision.

Hey guys, really hoping to get some answers here. My employer concurrently filed i-140 and i1-485 under EB1C April last year. My i-140 has been approved in June 2018 and i-485 has been pending for more than 180 days. My EAD was never filed along with the above when it should have, however its now been filed on the 1st week of October and I got receipt for the same. Questions I had -
1) My employer is considering terminating my employment with them, not finalized yet. However, if this happens - can I use the termination letter to file EAD expediting? My biggest fear is that this shouldnt upset the pending i-485. My file is with Nebraska and I heard that a job offer is usually not enough there. Hence, will sending the letter mess up my i-485 pending case?
2) I am in talks with other prospective employers. Lets say prospective employer A provides me the offer letter and I use that to expedite the EAD. However, once I receive the EAD and I choose to go with prospective employer B due to a better offer. Will this be a cause for concern?

Thanks so much for your responses during these difficult times!

Hi guys,

I applied for my EAD expedite on October 17th and contacted my local congressman on October 18th who send in all my supporting documents on the 18th. My congressman send me the feedback that they received from USCIS:

" Thank you for your inquiry regarding this constituent’s immigration matter.  We have requested the file and it will be reviewed by an officer once we receive the file.  Your constituent should receive a decision or notice of other action within 30 days of the date of this notice."

What does this mean? And how long does it usually take to get a response from USCIS? If someone who was in a similar situation has a timeline that they could share with me I would really appreciate it.

Thank you :)
