Hi all, thanks in advance for any help.  I have some questions regarding the expedite process. Firstly.. a quick backstory. I filed for an Adjustment of Status from my F-1 because I got married. I am currently working on EAD associated with the F-1 OPT program. This EAD expires mid June. My  I-765 was received by USCIS on 1/3/2020. Originally, we were ok with the EAD not overlapping and temporarily leaving my job. However, now with the COVID SIP situation, my husband is not able to work as he works in a non-essential construction site. We're very concerned about both being unemployed for a period of time.

 

Questions: 

1) Do you think this suffices as a severe enough financial loss? I can have my company provide a letter documenting my salary and how this would impact our clients and our projects.

2) Should I start the process of the expedite now? Or wait until a closer date?

You need to document your financial loss, would be nigh on impossible to document the companies loss especially when you would have been leaving anyway.

How did you get through to the representative? I'm having issues finding the right options to press to get through to a customer service representative.

Press the option for entering your case status. Once you enter your case number and they read out your status, they will give you additional options and one of them is expedite. I think it’s option 3. 

AOS via F-1 

  • Feb 3, 2020 - Application received
  • March 5, 2020 - Biometrics completed
  • March 19, 2020 - RFE requested
  • April 20, 2020 - Response to RFE received
  • April 27, 2020 - EAD expedite requested, evidence requested and submitted
  • April 28, 2020 - Request for additional information received
  • April 28, 2020 - New card is being produced!!
  • May 1, 2020 - Courtesy letter about medical exam received
  • May 5, 2020 - Case ready to be scheduled for interview
  • October 19, 2020 - Interview scheduled notice
  • November 10, 2020 - Interview date
  • November 12, 2020 - AOS approved

Faxed the requested information last Tuesday evening. Still nothing... I felt so good after calling and placing the expedite request, now it's just nerve  wrecking 😣

Hi everyone,

 

I'm on F-1 OPT, which is going to expire on May 20th. 

I got married in Jan (reentered the country on Jan 2nd from a overseas trip, but I have been in the US for about 10 years and travel a crazy ton for work. Didn't know about the 90-day rule thing before I started this process..., and well the deed is done so just fingers crossed this won't come up) and this is my AOS timeline:

 

2/21 Fedex
2/24 signed received, priority date
3/6 NOA text, date of notice
3/9 checks cashed
3/13 NOA for biometrics 3/31, date of notice
 

Obviously didn't go to biometrics and am just patiently waiting for it to be rescheduled (I didn't contact them, just didn't show up).

 

I was originally going to expedite the combo card as soon as I get biometrics done, because I do still really need my income after May 20 and was hoping to not have a gap. Plus originally, I will need to travel pretty soon for work reason. 

My question now is .. If I can't get anything done and the OPT expires, do I reach out to my employer and tell them to stop paying me after May 20? I work in the arts and everything is cancelled right now, but we will make up for the events after the pandemic is over. I'm technically not working at the moment. It is a bit of a grey area since I'm still getting a paycheck every other week. My contract expires in July so I'm still getting paid until then unless I contact them.

 

As soon as biometrics can be done, I will do the expedite base on severe finanical loss. Would my original contract that states I have work until July be enough evidence?

Just received my husbands EAD card in the mail. It was sent out from USCIS on 4/21. Our I485 also changed to Ready to Be Scheduled for An Interview on 4/22. So thankful the EAD process is over for us! It was a stressful month. Good luck to everyone.

I'm sorry to hear that. I think I saw from someone else in this forum that you're allowed to resubmit an expedite request after a certain amount of days. I think the person was denied expedite the first time, resubmitted, and was approved the second time. Maybe you could give that a try? I know some people go through their congressman so maybe resubmitting through their office would be another option.
