1. Typically they can’t do anything within processing time, if they inquire they’ll get a default ‘is within default time’ reply back. Although the processing time after expedite approval should be 30-45 days if I’m not mistaken. So after that you could try.

Meanwhile my I-131 got a status update that they’ve applied the fingerprints to it. Could be unrelated, could mean they’re looking at it to have a combo card go through. I don’t know yet.

Ok. Its been 36 days since my expedite was approved. My I-131 got the fingerprint update the same day they updated that they got my RFE so i dont even know what they are about to do next week. I am just watching each day to see when I will get an update.

Does anyone have experience requesting an expedite even if you received an RFE? I have an RFE for the I-485 which I'm working on responding to. I know they wouldn't process by EAD until that RFE is approved, but should I bother requesting an expedite for the EAD in the meantime so they have it on file? Or should I just wait until they've received my RFE response and then request it. 

 

My current EAD expires at the end of May.

AOS via F-1 

  • Feb 3, 2020 - Application received
  • March 5, 2020 - Biometrics completed
  • March 19, 2020 - RFE requested
  • April 20, 2020 - Response to RFE received
  • April 27, 2020 - EAD expedite requested, evidence requested and submitted
  • April 28, 2020 - Request for additional information received
  • April 28, 2020 - New card is being produced!!
  • May 1, 2020 - Courtesy letter about medical exam received
  • May 5, 2020 - Case ready to be scheduled for interview
  • October 19, 2020 - Interview scheduled notice
  • November 10, 2020 - Interview date
  • November 12, 2020 - AOS approved

I am in a really similar situation. Current EAD expires end of May and trying to avoid losing my job during this COVID thing. Nightmare :(

I recommend sending in the RFE first because once you have gotten an RFE, they have stopped looking at your case until they receive that RFE. Once theyhave confirmed they  received your RFE, then you can do the expedite request.

@Wayne386 Just got off the phone. Was immediately transferred to a T2 officer after I requested, without being on hold for a second so I'm guessing they're pushing back on transfers really hard. Either way, was told my case was still not processed and probably still on hold after the RFE for the I-485 despite the first expedite being approved.

 

The second expedite wasn't touched, not even after faxing in advance, the third expedite that they initiated in an effort to 'escalate' hasn't been touched and I was told to wait because their system wouldn't allow another expedite since two are pending (I wasn't interested in adding another expedite anyways to be honest). So instead I asked to put in a 'service request based on administrative error' (I heard about this from someone else, it's typically used when a mistake is made, or a case is stuck on or you've been waiting a long time) and the representative on the phone told me that that was a good idea and that she could put that in the system. 

 

So now we wait some more. 

 

This is what my case's page looks like now, it's getting a bit ridiculous with 4 different reference numbers.

From what I can tell reference numbers that start with T1 are tier 1 service requests, WKD is tier 2.

Thanks, that's what I figured. And thanks for sharing that link, I hadn't heard that. That's good news, even though I'm planning on submitting ASAP.

It seems everything thats tried just gets stuck. Im just waiting until the end of the month to see what happens, because they are jut gonna be making excuses. Its either that or I submit a e-request.

Yeah… I'm more of the 'the squeaky wheel get's the grease' philosophy so I just keep badgering them until I get results. Honestly it's more of a control thing I guess, can't sit still.

Good morning all,

I am new to this thread. We are considering to file an expedite request for EAD, too. Does anybody know if you have to take the job offer from the employer that you send the offer letter from? Example: I sent offer letter from Employer A to USCIS as evidence and then start working for Employer B for various reasons. Does USCIS check this? I am just wondering because I know that H1B visa is tied to a specific employer.
