Timeline

I had a successful interview at Morgan Stanley yesterday and I was asked if I have the right to work. I explained that I have unrestricted work permit and that I am awaiting my green card interview. I also specified that I will not need sponsorship in the future. 

 

Today, I received a call from the branch manager (person who interviewed me) and told me that after contacting recruiting group and making recommendation to hire me THEY SAID THAT THEY CANNOT OFFER A JOB TO ANYONE OTHER THAN A US CITIZEN OR SOMEONE WHO IS ALREADY A PERMANENT RESIDENT. Is this not against the law? I think this is very messed up. Can I do something about this?

It’s very common that some position couldn’t provide sponsorship for a VISA, they couldn’t justify why they have to hire foreigners.

But, for us we don’t need a sponsor, we have EAD and green card will be in our hand soon, so I bet the hiring manager doesn’t quite understand which is your current situation, and for big company often they will strictly follow the rules, and I met the same thing like that, so I chose another company which doesn’t require GC on hand and also could give me an offer. 

Is that possible for them to hold that position for you until you get your green card? 

I-485/765/131:

06/01/2018 - Sent AOS/EAD/AP through UPS, received NOA1 on 6/11. Received bio appointment on 6/15 and completed on scheduled date 6/29.

07/06/2018 - Submitted EAD expedite request with job offer, reason was financial loss. Received EAD/AP combo card on 08/04. AOS changed to 'Case is ready to be scheduled for an interview' on 7/24.

07/23/2019 - AOS interview was scheduled on 8/27. In the interview USCIS can't make decision because original K1 file got split up somewhere.

11/25/2019 - AOS got approved, received the actual card in mail on 12/2.

I-751:

09/05/2021 - Sent ROC through FedEx, delivered on 9/7, received message e-notification on 9/9 stated case was received, check is cashed on 9/10, NOA1 in mailbox on 9/13.

10/28/2021 - Fingerprints have been taken (Reuse).

01/17/2023 -  Case was transferred To Another Office

01/26/2023 - Case Was Approved

N-400:

08/28/2022 - Submitted N-400 online, NOA1 on 08/29/2022, with estimate time 10 months for decision. Biometrics is reused.

11/23/2022 - Interview was scheduled on 1/11/2023, it was a combo interview for I751/N400. Both cases were verbally approved. System hasn't been updated yet. 

01/26/2023 - Form N-400 recommended to be approved --> Oath Ceremony Will Be Scheduled

02/06/2023 -  Oath Ceremony Notice Was Mailed, Oath on 2/22

02/22/2023 - Oath Ceremony, applied passport the same day, with estimated receiving date in middle of May. ALL DONE!!

10/30/2018: Went to Infopass, officer has not made a decision yet, an email was sent to him tell him I came to inquire

03/26/2019: Moved so updated our address online with USCIS

04/16/2019: I-130 petition approved

04/20/2019: approval notice received in the mail

04/22/2019: received notification of RFE for AOS I-485

06/01/2019: RFE finally received after being lost in the mail, asking for a new medical exam

06/06/2019: Response to RFE sent, received the next day 06/07/2019

06/17/2019: Received notification of another RFE, 3rd time will be the charm hopefully

06/22/2019: RFE received for new medical

07/02/2019: Went to doctor for new medical

07/11/2019: I-485 approved without new medical exam

07/18/2019: Green Card received in mail

A letter from your employer stating that you will lose your job by xyz date if your EAD is not received by then; also explaining in the letter that it will be a financial loss for them if they let you to go, to hire somebody else and train them. So they will rather keep you since you are already familiar with what is expected of you.

Also a letter by you, explaining how losing your job will be a financial loss.

I have been following this thread. I just wanted to share my experience about I 765 expedite request. I am currently on OPT, which expires on 08/07/2018 and my I-140 was approved in May, 2018. So, I decided to apply EAD through 485 not through STEM OPT. My category for EAD expedite is 'severe loss to a company and myself + possible medical emergency situation'. Here is my timeline below.

 

* May 2018: I-140 approved

* I-485/I-765/I-131 filed on 05/18/2018 (National Benefits Center)

* I-765 expedite request by mail on 06/25/2018 (only including my I 765 application info)

* I-765 expedite request by phone on 07/05/2018 (including my and spouse I 765 application info)

* Senator's office submitted the request to USCIS on behalf of me on 07/06/2018 (including my and spouse I 765 application info)

* USCIS requested an evidence via FAX (816-251-2290) for the expedite on 07/10/2018 

* I tried to fax at many different location (FEDEX, Libarary, etc) on 07/11/2018. No luck with FAX. I just mailed the evidence on 07/12/2018.

* During 07/12/2018-07/13/2018, I used online FAX website to set a fax schedule with 20 min interval for a day. None of faxes went through. This fxxking FAX never answered.

 

Today 07/13/2018, I received USCIS response to senator's request from the senator's office. It says, 'USCIS will process the constituent's request ASAP'.

 

Then, I just got an update in USCIS my case 'New card is being produced'.  My spouse request for EAD also got approved at the same time. Provided that my mail with the evidence for the expedite is not delivered, I think Senator's office request made the difference. Hopefully, I get an EAD in my hand soon. Just wanted to thank you guys for the info in this thread.

 

 

Congrats!!! do you see the request made by Senator's office in the USCIS Case History? I tried to expedite mine but it didn't appear there, so I wonder if the Senator's office actually sent the request to USCIS

That is not possible, only they can see it.

@JoonP what’s the address you mail to? Is it the NBC P.O. Box which shows in the expedite letter? I had the same problem, faxed so many times in different locations it won’t get through at all!

Check the address written on your 765 reciept. I talked to tier 2 officer about fax issue and was told to send the evidence via mail to the address on 765 reciept.
