Former OFW, flew to the USA directly from Dubai on K1. Going to the PH for vacation soon, do i need CFO?

hi all, sorry if this has been answered before but just want to ask in case new info is available.

 

i came to the us on a K1 visa. i flew to the USA directly from Dubai so I did not need to get a CFO sticker at that time. We are planning on vacationing to the PH soon, do I need to get CFO done while I am there so that I can exit the country?

 

If it matters, i just have EAD/AP now, which is what i will use to travel. my AOS is still pending and it's likely that i won't have my gc when i travel.

You have your green card?   You are good to go without CFO ... it won't be asked for.

 

CFO is for EXITING Emigrates only,  if you have a green card, you are not the an "emigrate" anymore.

No green card yet, i just have my EAD/AP now. Would they treat EAD/AP similar to a gc in this situation ie that they can consider me not an emigrate anymore with it?

The AP card should be fine.  I know of a few couples recently that traveled with the AP card (combo card) .   The AP card does show you are residing in the USA
