Non-immigrant visa for spouse

Hi, 

 

I have the following question. I'm a foreign, EU citizen married to a US citizen, both of us living abroad. I might need to visit the US soon (on my own business) and want to apply for a non-immigrant visa (I don't want an immigrant visa or a green card, as I don't intend to settle in the US). I've heard that consular officers very rarely issue non-immigrant visas to people who have a US spouse, as they are considered potential immigrants. Is that the case? What are my chances of getting a non-immigrant visa?

The refusal rate last fiscal year for Bulgarian applicants was 15%. That said, it really comes down to the individual case and your ties to return home. What are your ties to return home?

Having a USC spouse is a tie to the US. The nature of your work sounds like it's not strongly tied to being back home, too.

Well, that's the refusal rate for all applicants.

 

I myself have had numerous US visas (F1, J1, journalist visa) over the years (I spent nearly ten years in the US) and I've never exceeded my legal stay, but I still worry. This things are so random, especially when some bored consular officer is reading you file.

True...it's a starting point but doesn't really mean anything with an individual case.

 

IMO, that's both a positive and a negative. You've spent a lot of time in the US and have a USC spouse, apparently without strong ties to remain home. In a vacuum, that makes getting a B visa quite difficult. But having been in the US without violating your status is a considerable plus as well.

 

Personally, I wouldn't worry about what the chances are and just apply to find out. The only thing to lose is the $160 fee. Good luck!
