There was a misunderstanding I guess. When he filed the DS 160 he did said he was refused a visa once. What I said is when preparing for this interview we forgot about the fact that he said there he was a family friend. Also he has never been married before

Would explain the denial.  It sounds like he was vague/evasive/lying in the past interview about the truth of your relationship, and it came back to bite him during this one.  Not so much a "misunderstanding" if he told the CO he was a family friend only, and hid the truth he was in a full relationship with you during that time.  CR-1 is an alternative option for you now.

When the Beneficiary is applying for the visa itself, thats where the question is asked.

I believe it is asked in both DS-160 and DS-260. I can't be too sure if it was asked in I-129F (I filled that out too long ago). But I can tell you I'm pretty sure any form a non-citizen has to fill up for entry into USA, including the ESTA application for citizens of Visa-Waiver countries, has this question. I filled one just yesterday when I changed my passport.

It’s not on the 129f. It’s on the ds-160 that they ask that.

That doesn’t seem right either because having a family friend in the States will have no bearing on the K1.

Normally, all cases go through some form of administrative processing.  It can be hours, days, weeks, months, or (rarely) years. But since you earlier said " The paperwork he received says he his not eligible and they will return the petition to USCIS ", it would seem reasonable that it means they are processing the return to USCIS.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It honestly sounds like something came up during the interview and he got called out on something by the CO. Now he is just to ashamed to tell his fiancé what actually happened. Which as you know it would not be the first time something like this happened here on VJ.
