Sorry to hear of your denial. How long ago was your last visit? K1's don't get reaffirmed they expire so you can either refile a K1 (Not wise) or go their marry and file a I-130 and wait the 12 to 14 months to interview.

Does anyone see where on the I-129 it asks this questions?

Most times it is not an error. It is simply a lie.

 

Even if a million people online forgive the applicant, it will not help them with a denial.

They ask that in the DS-160 form.

The i-129f is the petition by the petitioner for the beneficiary to be allowed to apply for the K-1 visa.

 

When the Beneficiary is applying for the visa itself, thats where the question is asked.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

perhaps he is still married? the fact he LIED about being denied a visa shows some sort of character!

i am sorry, but it was only a few years ago he applied for a visa. i would remember if i applied and got denied. why are people so scared to admit this? Do people REALLY think that being denied a tourist visa has some bearing on a K1 visa and therefore say 'NO" hoping the embassay doesnt catch it?

that would be the only reason and a sad one:/ 

 

it does not seem he got denied because they dont believe . he was going to get married to you.  either they took the material misrep seriously or he is not free to marry.

As far I can see it is highly probably he got denied because he pretty much lied. there is a question I think is the g325 or ds 256 I dont remember where but they ask you if you apply for visas previously (tourist, work, education) and the outcome. In my case I had 1 denied tourist visa denied 5 years before meeting my now husband (it was actually a renovation) and I got denied. Of course I disclaimed it but it was never brought up during my interview.

 

Other thing, I think I read your fiance is from Ghana (if is not, pardon me and dont read the rest)....but Ghana, as any other african country is considered high fraud, so k1 visa denials are very frequent even marriage visas. I suggest you if you are planning to reapply as a married woman, to have a few visits under your belt. I've seen couples from nigeria or morocco that even after a few visits as a married couples, they still get denied.
