Hi,

I am currently a graduate student (I will graduate in the Spring). I married a U.S. citizen, we have been together for a long time and maybe we should have started this process a long time ago, but we did not know it was such a slow process. We have already prepared all the documents (i-130, i485, i765, etc.) We also spoke with two lawyers and we are not sure what to do because they gave us different answers. 

 

I should start working either July or August here in the U.S. What should I do to be allowed to work here?

 

  1. File for adjustment of status. I am not sure the EAD will arrive on time. (one of the two lawyers said that it will take way longer than 3/4 months)
  2. File for adjustment of status without including form i765 and file at the same time for OPT
  3. File for OPT and in a few months file for adjustment of status 
  4. File for OPT and Adjustment of status at the same time (advice from the other lawyer)
  5.

File for AOS and DON'T listen to lawyers. Just use VJ here and you will be fine. If you file for AOS within the next couple of weeks you should have your EAD by July.
