Wrong spelling of middle name on prior marriage certificate

Hi,

 

I am in the UK and my fiancé is based in the USA and we are in the process of gathering all  documents to submit the I 129f and I just realised my middle name is spelt wrong by one letter on my previous marriage certificate. My middle name is Jay and it shows it as Joy. My first and maiden names are spelt correctly. 

 

Do do I need to submit my prior marriage certificate as well as my divorce decree absolut at this point? Or can I just submit my decree absolut? Or, does it not matter really about my middle name as my first and last names are correct? Or should I put it in the field for also known as names?

 

Just don’t want to confuse or cause an RFE, and wondered if anyone had any advice?

Your previous marriage certificate is not needed for any immigration process.

Some documents ask previous or other names used. That would be an appropriate place to give that married name. And you will have to give details of former spouses on some forms, but not prove it with a marriage certificate. I just haven't heard of needing to link names in that way.  My wife and I didn't...going from K1 through citizenship and we both had previous marriages. She had a maiden name birth certificate and a married name passport. I think they will get it since they see this kind of stuff daily. They want to know you are both free to marry and that divorce decree will come up several times including the citizenship application.

 

And a tip for UK divorce decrees. They are not signed by a judge and a few at USCIS think all decrees worldwide would be signed. So if you scan it and send to your fiancé, make sure he gets the whole A4 image on his American 8.5x11 paper. There is a teeny tiny footer at the very bottom right that says something like degree absolute divorce final (I forget exactly). That can easily be cut off on shorter US paper. We reduced the photocopy slightly to get it on paper size to match the rest of the petition. And we highlighted that tiny footer as well as the section in the middle that says "on this day was made final..." again I don't remember the words. A few people I know that got RFEs for no signature were able to get them reversed by doing that highlighting and sending back saying the UK decree absolute is never signed but only stamped by the court. We did not get an RFE but we made sure the footer was there and highlighted.
