Required Security Checks

Hi All,

 

I received this email this morning in regards to my service request:

 

On 02/16/2018, you or your representative contacted U.S. Citizenship and Immigration Services (USCIS) about your I-129F because you believe your case is outside normal processing times.

Your case is currently delayed because the required security checks are still pending. We cannot make a decision on your case until we receive the results of these security checks.

We hope this information is helpful to you.

 

When I filed we had a new edition to the I-129F form that required that I submit background checks with my package which I did.  I had two DUI's on my criminal record over 12 years ago, I know dumb move on my end, but will this hurt my petition? I read the background check requirements over and over and I didn't see this as an issue.  Did anyone else have anything on their record that deemed their petition inadmissible?

This has been debated a bit here.  The actually background checks are pretty rudimentary.  Nothing more than a name check with the beneficiary and a name/SSN/Passport check with the petitioner.  The DUI will show up but as long as you completed the court required sentence you should be OK.  The USCIS actually has little or no info on the beneficiary.  Heck, a passport number isn't even required with the I-129f.  The best we can tell, background checks are just another one of the standard excuses used to justify the delay.

 

One beneficiary here shared that his petition was stamped basically stating that only the petitioner is checked and USCIS does not have access to all criminal databases so they are not responsible if the petitioner is actually a criminal... Where I live they have a pretty thorough background check to buy a gun.  It is tied to state and federal databases and the answer comes back in under a minute.  

 

I would not be overly concerned by their "canned" answers.  If I were I would believe that almost 9 months into my journey, they haven't even assigned my petition for review and I should call back in 45 days.  I refuse to believe that B$.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

Where is it required, on form 1615-0001 Expires 08/31/2018.  I dont see a requirement there? There only bunch of questions we are supposed to answer for part 3 on page 8.  Did you attach any background check document with your application?

07/27/17 - K1 packet sent at the end of day.

07/31/17 - NOA1

03/22/18 - NOA2

08/28/18 - expected date for medical completion - Sputum test was needed

09/22/18 - anticipated interview date

It's a blanket response. Think of the automated email response you get when you request a password reset. It's the same thing, basically. It means that they can't tell you where in the process you are, that they're working on it and that you have to wait. :(

I don't recall anything like that either.  I do remember the questions and violence and alcohol related arrests may bring up some more questions.  I was able to just answer "no" all the way down and never thought about it again.

You're right and I appreciate your answers and support.  I just read in to the application AGAIN and I misread the part where I only needed to submit copies of my background check to certain crimes.  I may have set myself up for this delay and provided too much info?? :( I'll just sit back and wait! Thanks again!

@NoProblem you're right, I misread the part where traffic violations that had alcohol related offenses only needed an explanation.  I provided the background check and explanation and may have put my foot in my mouth providing too much info.  I'll just wait it out! :(

Uh oh.. I'm in the exact same position as you... 2 DUIs and I provided a background check and court certified dispositions.... its a little frustrating to think we might have sent too much information when we are afraid of getting an RFE from not sending enough.. WTH do these people want from us???? well i better calm down, i have at least 2 more months before i can expect to hear anything. God I just want this all to be over :unsure:

The DUIs shouldn't be an issue with getting the petition approved. I would suggest making sure the beneficiary is aware of any criminal history as they may be asked about it, but otherwise it shouldn't be an issue.

 

Unlike some responses here, I'd disagree that it's a blanket response. It's a common one for delayed cases, sure, but I don't think they are just making it up. Sometimes background checks take longer for various reasons. USCIS does not conduct the background checks themselves...they request them from various agencies then await a response. They cannot proceed until they get a response. Sometimes, for various reasons or seemingly randomly, one of those checks takes longer (the FBI one being the most common culprit). I have done/currently do work for federal agencies and sometimes the checks do seem to take longer than others. Most come back within days, but sometimes they take considerably longer.

Did you receive already your noa 2?or your still waiting for the security check? We are in the same situation it’s been 252 days already and we haven’t heard anything since we receive the letter that the paper is on security check
