Advance parole and visa waiver

Hi!  I entered the US on a visa waiver in June, filed my Green Card application within the 90 day period, got advance parole, case ready to be scheduled for an interview, and I want to travel abroad.  I heard conflicting stories and I am afraid of not being able to re-enter the US at the end of my trip.  My lawyer is telling me that the use of advance parole is possibly tricky for people who are on a visa waiver -in my case now expired although it was still valid when I filed.

 Has anyone in this situation traveled abroad recently?  What was your experience?  Any problem?

Any entry on AP carries a risk as entry is at the discretion of the CPB officer. Additionally, AOS could be denied for some reason while abroad, which automatically cancels the AP.

 

That said, unless there is a reason for the officer to deny you entry, you should be fine in doing so. Coming from a VWP country doesn't hurt this at all.
