Actually your wrong there because if you are working outside the USA then you are REQUIRED to file a tax return with IRS if you are a USC or a GC holder. There is no tax on the first $92,500(last I checked) but you still need to file for taxes. I worked 3 years overseas in the Middle East so I am well aware of what someone needs to do to be compliant with the IRS. I went 2011living  completely out of the USA and I still had to pay taxes on all that I earned that year.

 

 

If you are using benefits for the USC children then you are fine.

Yeah that’s why i told already we filed a tax every year what we earn out of US. You are right and understood about my tax part. We are doing the same what you wrote.

I believe she states above that her husband has not been working since September so their eligibility could be based on current income, which might be close to zero.

US citizens are always required to file tax return. Look at the back of the US passport if you have any doubts. $90,000 is a limit below which no tax needs to be paid in US if it has been paid in other country and that country has treaty agreement with US on double taxation. You or he should be filing return because it's a requirement of every US citizen, not because of immigration.

 

If you're claiming medical benefits saying you have no job or US income but made $86k elsewhere, it looks like a scam... And that $86k income elsewhere and no job in US would not allow him to sponsor you, he needs to be making over poverty limit and be employed right now, not show he made it during the year - unless you decide to use the assets.

Did not see this specifically addressed, but you will need an affidavit of support

your husband's OUS income will not be acceptable evidence that he can support you, the income needs to be current

he needs to get a job or you need someone else to sponsor
