you need to be able to pass the amount needed financially to support another 125% above poverty level with the amount in your household

Thanks for reply.... but if we file tax as foreign income $86,000, and we are taking medical benefit for kids in US ( me and my kids already shifted in September 2017) and i applied for my change of status.  so still can my husband sponsor me? As foreign income less than $90,000 we no need to pay tax but we still file because for my immigration is required.

Like someone is telling me if im taking benefits under my husband SS number may be it will effect for my immigration.is it true? Should I stop medical for my kids asap?

Are the kids USC's or no? If they are then don't worry about it. The question is if you have a income of $86k then why are you claiming any type of benefits, what kind of benefits, Medicaid?

Seriously I make $10k less than that with 4 kids....... Still don't receive any kind of benefits.

You may not need to pay taxes, but the income could disqualify one from receive certain benefits.

I saw on the timeline area that AOS is what is waiting on, and when the talk of foreign income, does that mean he is not in the USA making this money? and is that how the kids are on government benefits?

Maybe because according to the US he isn't making this money until he files his taxes. Then more than likely they maybe owing money to the state for reimbursement of those benefits'. Also how is the USC making enough to sponsor the family if they are already on benefits????????

something here doesn't add up, I didn't think if you had out in the system already an AOS meaning USC has already brought someone here, that they could have filed for benefits without it being flagged.

 

I think what we need is more information to give a proper analysis of the situation.

I completely agree with this that is why my first question was if the children were USC's or not?  This doesn't really add up at all of course no timeline and no real way to tell how that person came here or is coming here.

First of all my both kids are US citizens.

secondly if someone has job out of US, and earning less than  $90,000 they no need to file a tax only if we earn more than $90,000 then we need to file a tax above 90,000 whatever is amount we file tax and tax returns.
third if US citizen spend 365 days out of US then again no tax.

we are filing only because of our immigration they need these requirements. Me and my husband never lived here. Never got any benefits.

why we have medical cause my husband has no job since September. That’s why my question was if we have medical benefit so can still my husband apply for me or not. Of course for this yr our tax will be very low but above $40,000, 86000 was for 2016.

if your husband has no job, and no reported tax return, he can not support you, unless I am reading this wrong you will have to have a joint sponsor, depending on the family size, you must meet again the 125% of poverty guidelines for the household.

if the kids are receiving free medical benefits it has already been proven that those guidelines have not been met, and if you can prove to met those guidelines to sponsor it is likely the benefit will end. 

 

however you are stating the kids are USC but you and your husband have never lived here never gotten benefits, if you have never lived in USA how can your husband sponsor you?

 

you have to understand the way that you are giving off and the amount of information you are giving is not making sense. at least to me 

 

so to answer you orig question if the kids are receiving benefits already yes this could cause a problem with your husband sponsoring anyone alone
