I have seen this question a few times this week.  If the Philippines beneficiary is currently in an other country as an OFW, can they interview in that country?  What about GCP?  If they interview and leave from a third country do they need to abide by the rules in the Philippines?

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

Yes, the OFW can interview in the country that they are presently in at that point in time AS LONG as they are a valid resident of that country. Such as having a work/family visa for that particular country is fine.

 

GCP is not needed as long as they DO NOT fly to the Philippines and then to the USA. Yes, that is a question that does occasionally come up here as well. If they touch Philippine soil then they are required to go through GCP before heading to the USA and they can/will be turned away at the airport. We have had people fly out of the Philippines to the USA using the visa from a 3rd country(Singapore) and there were no issues. But that is VERY RARE to do this.

 

If they are residents in that country they can abide by those rules in that country such as divorce. It is common for Filipinos abroad to get a divorce in HK, Singapore, or any other country that allows divorce because the Philippines does not recognize divorce. But the USA will recognize that divorce and that person can be petitioned to live in the USA for a K1/CR1 visa after that as long as they have that divorce decree in hand.

Yup they can interview in another country where they are a legal resident. 

 

CFO is a  Philippine requirement, not a visa requirement .. if you are not in the Philippines .. no CFO ;)
