Timeline

The more i read to look at my options, the more i get confused. So my question is: What is the quickest way to return to the US? should we file for a K1 or should we get married in germany and then apply for a DCF?

It would be great if anyone could help

If you are able to marry now and do DCF, definitely definitely do it that way. The K1 process is quite long and I'm not sure it's possible to apply unless you're in the US. Plus it costs more in the long run and is a lot more hassle. DCF will result in an immigrant visa in half a year or so and the only future things you'd have to do are removal of conditions and citizenship.

US Immigration Timeline

-------------------------

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

Oh wait, I've just seen in another post that you say you and your fiance have been separated for four months. If your fiance isn't living in Germany, I'm quite sure DCF isn't a possibility for you. If it's possible for him to live in Germany for six months and then apply for DCF, you would find the process better and less money/hassle than the K1 i bet.

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

You have to tell us more about you and your fiance...for exemple is he in the military? For sure DCF looks like the fastest way. :thumbs:

03/29/2007 Got letter from USCIS to provide evidence that our marriage is bona fide

04/02/2007 Sent to USCIS lots of evidence

05/03/2007 I have an unofficial "PETITION APPROVED" ...waiting for confirmation from Consulate

05/07/2007 Received email from USCIS ROME confirming that our petition was approved (why Rome? because we complained to the District Office Rome about the Sub-Office Frankfurt..it took too long for our petition to be approved)...now waiting for the interview letter from the Consulate

05/18/2007 E-mail from IV Frankfurt, our interview was scheduled for May 29th

05/19/2007 Packet 4 in the mail: ja ja ja interview letter

05/29/2007 Interview at 7.30 a.m. APPROVED Thank you, God!

06/01/2007 Visa arrived !

06/03/2007 Mayday on the plane POE Cincinnati

Living in Maryland

06/21/2007 Welcome Notice from USCIS

06/29/2007 Applied for SSN at the local Office

07/07/2007 Green Card arrived

07/09/2007 Another 2 Welcome Letters from USCIS...God, they really love me! :D

07/20/2007 Social Security Card arrived

Yes they're right. Basically - if you can do a DCF - do it. It's the quickest. Usually the US citizen needs to be in Germany long enough to do so (residency status).

K-3 Visa

07/22/2006 - Applied for K1 - I-129F mailed to Vermont Service Center, VSC

08/02/2006 - Package got sent back requesting a different form (different revision). Proceeded to weep like a girl. Decided against fiance visa with newfound setback. Will wait for December wedding.

12/24/2006 - Marriage

02/05/2007 - I-130 sent to VSC and confirmed receipt following day.

02/13/2007 - I-130 NOA1 received

02/15/2007 - K-3 sent to Chicago and confirmed receipt following day.

02/26/2007 - K-3 NOA1

03/02/2007 - I-129F (K-3) sent to Vermont Service Center (from Missouri Service Center)

03/11/2007 - Received email notice: I-129F in VSC is now pending (whatever the heck that means)

04/05/2007 - I-130 and K-3 APPROVED! (email notice) (rec'd postal mail 04/13)

04/09/2007 - NVC received case (called 603 334 0700)

04/11/2007 - Shipped to Chennai.

05/17/2007 - Received confirmation of receiving package via postal mail in India with interview date! (took 36 days!)

06/15/2007 - Interview! VISA APPROVED!!

06/29/2007 - She's in my arms...

Thank u guys.

NO my fiance isnt in the military anymore. On http://www.visajourney.com/forums/index.ph...om&page=dcf it says that u can ask if u can apply for the DCF eventhough u r not living in that country. On that page they say they might let u do it, but its more like a favor than a requirement.

No, that is old.....started with the Adam Walsh Act (Jan 2007) the petitioner must have residence evidence in Germany, at least 6 months. You can call the Consulate in Frankfurt and ask about, they will tell you for sure.

If it is like I say, you still can go on the k1 route or the k3 if you guys get married.

Still check with the Consulate :thumbs: if you start k1, start right away , the sooner you start, the sooner you finish :dance:
