After a few years of being together my boyfriend and I have finally decided we want to tie the knot. We both want him to come to the U.S with me as i have two children who visit there dads so moving to another country isn't an option for us and he agrees. So the good ol' U.S.A it is. Now, I have never done this nor anyone in my family so I don't know the correct channels to go through and some help and guidance would be a great help. I don't know all these big legal terms so a lot of these site just confuse me. so forms and advice would help greatly. Oh and I don't know if it makes a difference or anything but, my boyfriend lives in Australia.

Well, first step is to meet each other. There are two routes you can go.

 

K1 visa: Fiance visa. This visa will take 8-10 months to be received. Once your visa is received, your fiance will have 6 months to come to the US to marry you. The moment he uses his visa to the US to marry; you guys have 90 days to marry  and then apply for adjustment of status. Your fiance will not be able to work right away until he gets a work permit. http://www.visajourney.com/content/k1guide

 

CR 1: Get married and apply for a spousal visa. This is a cheaper option and more ideal right now. It takes 12-14 months to receive the visa. Once your husband arrives, he can work right away. http://www.visajourney.com/content/i130guide1

If you've been together for more than two years and have met you can start the process. This is website where you will find the forms https://www.uscis.gov/i-129f  the first step is to meet and make sure you have proof of meeting (photographs, text messages, passport proof, etc..) Make sure you pay attention to the edition date of the petition form as the government changes the forms every once in a while. Fill out the petition, print it, make sure you have proof of relationship in the file (text messages, phone calls, images). You both also need Intent to Mary letters that will need to be signed by both of you. Be extremely careful in filling out the forms and double check everything. It should look professional and be easy to read though once printed and put into a binder. Once you submit the petition it takes a couple weeks to hear back and receive a case number/ NOA1 (notice of action 1) is what this first piece of paper from the USCIS is called. The next step is waiting to hear back if you've been approved or not. This is the longest process and may take up to a year. If approved he will need to go though a health check and embassy interview. For these steps I am not sure if they are the same in Australia as they are in Canada, so I would do further research. My best advice is to read up as much as you can about the process and save up some money.
