@Wuozopo thanks for the advice. What if I send the documents to NVC and write a letter that I couldn't pay taxes. Is there a chance they would delay my husband's green card

Saying you "couldn't pay taxes" doesn't work. That sounds like you needed to pay, but had no money.

Saying this will be acceptable for no tax return: (write in your particulars for each year)

In 2017, I was a full time student and earned $0 income. I was not require by the IRS to file a tax return because I earned below the $4050 minimum for a person with a filing status of Married Filing Separately.

In 2016, I was a employed part-time in the United Kingdom and earned $3210.89 income. I was not require by the IRS to file a tax return because I earned below the $4050 minimum for a person with a filing status of Married Filing Separately.

On an I-864 for spouse visas, you MUST send either a

  • tax return
  • a reason why you were not required to file according to the IRS

If you earned enough to file, but didn't file because you thought you didn't have to living abroad, you will get an RFE. If you have a legal reason you didn't file like earning less than $4050, you should not get an RFE if you write an proper explanation  statement to put behind your I-864 form.

NOA2 1/27/18, NVC received 2/13/18.  Still no case number, even though many with NOA2s and NVC arrivals well after mine have gotten theirs.  TOTES NOT FRUSTRATING OR ANYTHING

I'm curious if there is a connection between those of us in the new electronic system getting their numbers slower and those who aren't having it done faster.

I am in the new system, which means when I call NVC to check if I've got a case number yet I dial option 5 instead of 7.

Would be interested to hear others who have gotten their numbers, or haven't, and what option number they dial.  I suspect we would notice a trend.

I know that I have not had my NVC number assigned as of Friday last week (NVC Received my case on the 2/9/17) and I am part of the new system (option 5 group). I will call again this Friday as they said it should be within two weeks of the received date.

Well, if I hit 7 they say that I need to hit 5 because they (group 7, their new title) cannot access the file. Alas, that is the extent of my knowledge on the matter :-\

Mine too -- that's all I know.  But the fact that you're dialing option 5 and have been waiting even longer than me, whereas others with receipt days FAR after ours already have case numbers, tells me that the new system sucks and that people had best hope they aren't part of the option 5 group.

I am holding out hope that it will make its way to the embassy faster once completed. Fingers crossed!

True. However, the Montreal US embassy does ask for marriage certificates, divorce certificates, etc...  If we've never been married or divorced, do we simply check mark it off the packet 3 checklist even if we don't have such certificates?

I'm curious about that too. I've only just gotten my NOA2 so I haven't looked into the list yet. I'm visiting my fiance so I'll look more when I'm home. The Canada specific forum may have better info?

It seriously does confuse me because they want you to gather all these documents for the interview. : (

I believe the marriage/divorce decrees are only if they are applicable? That's just what I see from reading those. I could be wrong.

Just called NVC. They got our case today. She told me to wait about two weeks before calling for a case # - and then told me that I was welcome to call any time I wanted to check lol

There's such a thing in Canada as a Statement in Lieu of Certificate of Non-Impediment to Marriage Abroad. https://www.redsealnotary.com/Publications/2013-07-23-What-is-a-Certificate-of-Non-Impediment-for-Marriage-Abroad.php   However, i haven't read anything online requiring us to provide a certificate that proves our single status to the interview...

The good news is that when you get your number it's basically like 2-3 days now until it's sent to the embassy. I woke up this morning and looked at the CEAC tracker and it said "In Transit" and a few hours later it said "Ready". Amazing. It almost feels wrong moving so fast after all that waiting! Tomorrow, I have to go to the bank to pay the fee and my fiance will schedule his medical. Then seven days after the medical we can schedule the interview. UNREAL.

Only if you don't interview before your NOA2 expires. The petition  approval has an expiration date on the NOA2. If you go past that date, the American has to provide an updated letter of intent to extend the petition past the four months allowed.

Your Philippine specific K1 info is here https://ph.usembassy.gov/wp-content/uploads/sites/82/2016/08/K1-and-K2-Applicant-Interview-Preparation-Instructions-08112016-English-336KB.pdf

So it is not true that you have to get a letter of intent within 30 days prior to your interview? As long as the noa2 is not expired?
