Only if you don't interview before your NOA2 expires. The petition  approval has an expiration date on the NOA2. If you go past that date, the American has to provide an updated letter of intent to extend the petition past the four months allowed.

True. However, the Montreal US embassy does ask for marriage certificates, divorce certificates, etc...  If we've never been married or divorced, do we simply check mark it off the packet 3 checklist even if we don't have such certificates?

Anybody, whether in the US or elsewhere, has to earn a certain level of income before they are required to file a tax return. It's based on your filing status....Married, single, joint, etc.

In 2016 and 2017, for you with a status Married Filing Separately the cut off is earning equivalent to $4050. If you earned more than that, file a tax return. If you earned less than $4050, you do not file. 2015 was $4000. If you were single for all of a tax year, the amount earned before filing is over $10,000.

Your married affidavit of support (I-864) has instructions telling you what to provide instead of a tax return when you were not required by the IRS to file. Read the instructions before trying to do the form.

@Wuozopo thanks for the advice. What if I send the documents to NVC and write a letter that I couldn't pay taxes. Is there a chance they would delay my husband's green card

Have you had a chance to look at the form? Not being snarky, just asking. It only asks for your WAC number. Also, if you feel weird about doing it before you have your NVC number, you can fill it all out and save it (up to 30 days) before submitting.

Wouter,

I've been calling with Skype and it works great. It costs less than 0.02 per minute. My NOA2 was 02/02/2018, and after calling the NVC day after day they were able to tell me they received the case from USCIS on 02/13/2018, but as of yesterday they still have not placed it into their system so that I can receive my NVC case #. They suggested waiting two weeks before they will be able to issue the NVC case #.  Good luck.
